asda returns policy help really peed off

Hi i'll keep it short I bought guitar heros world tour band version from asda on the 23 of jan the cymbal on the drum kit stopped working on the 8th of march packed it all up went to asda tonight to return it with my receipt only wanting an exchange which has never been an issue in the past with any thing faulty was told i would have to contact the manufacturer and return it to them as they changed their policy at the end of jan.. but i bought mine jan 23 and was not informed of the change of returns policy when purchased this applies to ps3 wii and xbox consoles and games so i'm told i've now come home and checked out The Sale of Goods Act 1979 just want to know if i go back in tomorrow armed with necessary print outs and start going for it that i'm in the right. after all i don't want a refund just an exchange
It is the seller, not the manufacturer, who is responsible if goods do not conform to contract

If goods do not conform to contract at the time of sale, purchasers can request their money back "within a reasonable time". (This is not defined and will depend on circumstances)

any help and opinions or ideas would be helpful as i was spitting teeth when i came away tonight:mad: :mad: :mad:

    it is the retailer who is responsible, if the goods are faulty they must offer you either a repair, replacement or refund! they can choose, but a repair i would argue against as it has been such a short amount of time,

    btw it is s.14 of the sale of goods act which says what the goods must conform to, you would be arguing that the goods are not of satisfactory quality or free from minor defects

  • Agree with reehsetin, your contract is with the retailer. Goods which are faulty within 6 months of purchase, are deemed to have been faulty from the time of purchase, and it falls on the retailer to prove that they were not. Ask to speak to the manager and calmly use words like "inherent fault" and "not fit for purpose".
    I have just exchanged a 3 month old laptop at Tesco for a new one, and got a £70 refund on the price difference. Stand your ground!

  • hi just like to say thanks went back to asda they tried to tell me to go back to the manufacturer again the started reciting the sales of goods act sec14 advising them my contract is with them not the manufacturer etc and they completley backed down and exchanged well chuffed a small victory thank you all :T

    Well done you. Shops should know the law, but some rely on shoppers not knowing their rights.
    I would drop a line to Head office if i was you, seems as if the staff need some training.
    Find out who you are and do that on purpose (thanks to Owain Wyn Jones quoting Dolly Parton)
