How much did you receive in your own pocket?0

Would you have been better off using a "no win, no fee" company?" The greatest wealth is to live content with little."

Sorry for the long time no reply. I posted the update and then totally forgot that I had!But isn't cheezy a relative term? Some level of cheezy has to cross over the line. This seems beyond over the top to me. But your view is obviously right because the media and even the blogosphere - which cares about deeply about the price of tea in Topeka - has no interest.
You are obviously in the wrong thread or from a different planet.SolicitorMidlands wrote: »How much did you receive in your own pocket?
£1800 is what I am (still waiting) to receive. The Solicitor considered it to be a reasonably good/high pay out based on the injuries. I have no point of reference so rightly (or wrongly) went with his advice. The vehicle repairs came back as £2370, they also deducted £330 for the Physio sessions I received leaving £1800 to pay out to me.lilac_lady wrote: »Would you have been better off using a "no win, no fee" company?
No idea to be honest, it was a company vehicle and so it was all dealt with through the comapny's insurers.
SolicitorMidlands, any idea how long these things take to get paid out? I was told don't spend it til it's in your hand as there is no legal time limit on how long they take to pay out.0 -
So do you think £1800 is fair (after your physio payments taken out) will you use the £1800 completely towards physio work in the future?
I don't wish you bad or negative thoughts, just wonder why if your physio has been paid why you feel you should be due any other money?
Of course if you must have physio ongoing then that's a different story - you should receive all medical fees directly relating to your accident paid for - absolutely.
your response to the post a few above "You are obviously in the wrong thread or from a different planet." - couldn't agree more, the more I read it the more I thought I was hallucinating! chuckle0 -
It's an interesting point of view Jill I'll admit. Obviously I am biased in my response, but I will say this, I'm not of the sue them for what you can get culture.
The fees for the physio are paid and I have received the treatment for the injury. However, what about the pain and discomfort I was in whilst I was injured (don't strike up the violins just yet, but I did have several uncomfortable and sleepless nights in the first few weeks after the crash)? What about the things I could/should have been doing whilst I wasn't able? What about the time and transport costs I incurred travelling to the physio and to the independent consultant. These are tangible losses aren't they?
You seem to be coming at this from the point of repair the damage only. Okay, if I were a car, this would be okay together with car hire whilst I'm off the road, but when you are talking about physical injury of a person there is consequential loss to bear in mind too, and I would consider able bodied, pain free living to be fundamental to that.0 -
It will say in the judgment or consent order, but usually they have to be paid within 14 days. In practice though this will be paid to the solicitor that was dealing with your case, who should then forward it on to you, which could take a few more days.SolicitorMidlands, any idea how long these things take to get paid out?
Sonofa's second paragraph hit the nail on the head with this. General damages award is PSLA (Pain, Suffering and Loss of Amenity), and will always form part of the personal injury compensation. The principle of recovery in negligence cases is that you can only recover what you have lost. Now money for medication and such is an obvious loss, but general damages effectively financially compensate the Claimant for the pain and loss of amenity suffered whilst injured, which they would otherwise have not had to deal with.GoldenJill wrote:I don't wish you bad or negative thoughts, just wonder why if your physio has been paid why you feel you should be due any other money?"MIND IF I USE YOUR PHONE?
