I am writing this on behalf of my mother who is trying to sell her Park Home. The Park Home Owner has increased the age limit from 60 to 65 to prevent my mother selling her home to a perspective buyer. Does anyone know if he can do this and if not what the action can be taken. Help!!!:mad:

The relevant act is, I think, "Mobile Homes Act" 1983.
Under that the site owner must give occupiers a written statement of their legal rights & terms of their agreement (I am reading Shelter's "Housing Rights Guide 2008-2009). If site owner gave that some years ago & mum can't find it perhaps ask for another copy, quoting the act name (site owner will then know you have informed "Friends").

there is a 33 page guide you can download for "Residents and site owners". On page 11 it states

Can a resident sell his or her mobile home on site?
Yes. The resident has the right to sell his or her home on site and pass
on his or her agreement with the site owner to the person who buys the
mobile home. The sale must be to a person approved by the site owner
but the site owner cannot withhold his or her approval unreasonably. If
a resident considers that the site owner is withholding his or her approval
unreasonably, he or she can apply to the court or to an arbitrator for an
order requiring the site owner to give approval.

Might be worth looking through the rest of the guide...Site owner is entitled to a share of the sale price up to 10%, I think percentage up to 10% is his decision..

There is a lot about this on Radio 4 at the moment, with MPs getting involved. Basically, a lot of these parks are run by crooks who swindle vulnerable elderly people out of their property by preventing sales, and then buying the homes for a pittance.Been away for a while.0
