Credit Score!! One For Martin??

This is my first post, ill try not to waffle on but undoubtedly will.
Should be quite simple really. As a result of not paying bank charges it has affected my credit score. But my not paying was based on the fact the banks have currently put all reclaims on hold and despite all the threats of court action I knew they would do nothing; Why should I pay them while it is still being decided if their charges are unfair. What I would like to know is if these charges are found to be unfair does this mean I can legally have my credit score reset or improved because the poor score I now have was a result of these charges. I would be interested to hear anyone else's thoughts and opinions, I'm not sure if this subject has ever been raised before but its certainly something to think about? Id be happy to answer questions if I can.
Thanks for reading.

I think you need to sort your account out in order to keep your credit score neat/good.
If you've let your account get into arrears/overdrawn without permission because you don't think bank charges are fair, that's your issue.
You should bring your account up to date asap, hope that your credit score recovers, and deal with the bank charges seperately.0 -
What happens if the banks win after all the appeals?0

If the od is made up of charges, and the account was in dispute then yes the account shouldnt have been defaulted and you should get the default removed.
Will find some threads of info for you...LegalBeagles0 -
Tinkerbell 84, It is not my current account sorry, It is two previous accounts that were closed more than 18 months ago. My current account is bang upto date no problems whatsoever in the 12 months of opening it.
nomoneytoday, I really don't think the banks will win the appeals. As far as I'm aware every time they have been previously taken to court they have lost. Why should that change?0 -

Then defaults will probably stand, and people will stop being refunded on bank accounts.....but they won't win

So my credit score will be reset or improved, should these charges be found unfair?0

its one of those things that something like a group litigation will have to sort out after the test case and oft findings...theres many issues, like defaults, consequential loss, limitations act etc which individuals will want to look at should the charges be found unfair and declared unlawful thus (if indeed they go that far)...
example for you anyway
Have you been Defaulted due to these unfair charges ?
If you have been defaulted on your account due to the overdraft charges incurred then you can request that the default marks on your credit record are removed by inserting this paragraph into the letter. If you are unsure if this is the case you should check your credit record with the main Credit reference agencies.
Quote:
Additionally you have entered a default notice against my credit record. This default occurred merely in respect of unlawful charges levied by you. In addition to full payment of the sum detailed above I require that you remove the default entry from the register. Please note that mere correction or amendment to the entry will not be acceptable. Should this not be undertaken I will be forced to make a claim under s.7 and 13 of the Data Protection Act 1998 which will incur further costs.LegalBeagles0 -
When you say "inserting this paragraph into the letter", which letter exactly do you mean, the letter that I will send to the bank asking for my charges to be refunded?

What does your credit file actually say on the defaulted accounts?
What is the O/D balance of the accounts, and how much do you have in claims? How long has your claim been in court?Mama read so much about the dangers of drinking alcohol and eating chocolate that she immediately gave up reading.0 -
Loads of dodgy little companies will set up offering to reset your credit records (for a fee)davewelch00 wrote: »So my credit score will be reset or improved, should these charges be found unfair?0
