do they have to give some sort of warning first...

my car insurance has just been cancelled because i forgot to go and give my no claim bonus certificate, they sent me 2 reminders while i was on holiday and i made a call to them when i got back telling them why i havent been able to drop it off. they were fine and said drop it off soon as you can but it completely slipped my mind after that. today i went to hand it in and they told me that my insurance has been cancelled and a notification has been sent out, they said its an automated process and they cant cancel the cancelation due to it all being done electronically and coz of FSA regulations.

could someone confirm this is how it works?

dont they have to give some sort of warning before cancelling it?
such as 'if we havent recieved your no claim bonus certificate within 7 days we will cancel your policy"

what does the FSA say about it and is there any way i can appeal it?

    Check out your insurer complaints procedure and follow that.

    In the meantime you will need to get more insurance before you take the car onto a public road, and asap if fire/theft insurance is important to you.

    They would normally send a recorded deliver letter to your last known address giving you notice they would cancel in so many days.

    If you want to confirm they have done this ask for the recorded delivery letter reference / tracking number which can be checked on the royal mails website

    i am still insured till the 19th then they go i will be charged £45 to get a new policy with them, this is on top of the £45 they charged to cancel the policy.

    they havent sent no letter out apart from the one he said i will get tmrw, telling me they have started the process of cancelling my policy and after 7 days i will need a new insurance policy to drive the car and that i will need to return the policy certificate.

    Most companies can still stop the cancellation as long as they do it before the policy is physically cancelled eg the 19th

    swintons - they said the request has already been put in electronically so they cant stop it.

    They are a broker, which Insurer have they placed you with?

    I set up insurance for a family member a fortnight ago and on their website, before and after the payment is taken that proof of NCD is required in 7 days - and it's not in small print, it's right under the claims helpline number and the policy number. It was also in the confirmation e-mail they sent afterwards (although that did go straight to junk mail) and they followed it up with a phone call a couple of days from her local branch.

    In addition they sent you two letters stating the proof was overdue and even though you were on holiday you still neglected to post it off as soon as you could once you returned, even though i'm sure the letters would state the outcome if you didn't return it.

    So, what are your grounds for complaint? :think:

    You will probably be able to cut the cost over using a broker for a standard car policy.

    I wouldn't be paying £45 to start a new policy if i were you.

    I agree with Ben, I would not go back to them.

    I'm surprised Swintons are telling you they cannot stop the cancellation as most brokers would press the button on their computer to cancel the policy on or after the day they have told you cover stops. Unless they press the button in advance and post date the cancellation to the date. I've never heard of anyone doing this as you are forever getting the eleventh hour repreaves where the person pays the oustanding money etc (Swintons may well be different than other brokers).

    Try ringing the manager and be polite and ask them if they can stop the policy being cancelled. If they say no ask if you can pop into the office to look at the schedule that would have been printed off if they had cancelled the policy like they said. This would show dates and times etc (Obviously if you want them not to cancel it you will have to give them the correct no claims bonus)

    I think it would depend on what the wording of the cancellation letter letter issued was as to whether the cancellation could/should be stopped.
