ERYC Council, tree chopping.

Hi.

Was awoken this morning to find the council cutting big branches off trees outside our house, letting them rest up against my car.

They have scratched the front of my car, albeit not badly, but will need to be machine polished out. I went out, moved the car, then asked them (politely) what they thought they were doing.

The council representative (neanderthal man) grunted to me that He wouldn't put a complaint in if he was me, because they'd just fine me for being parked on a verge. He failed to take into account that the council refused us permission to park in our own drive, and we only have one parking space for a 4-bedroom house with 4 residents & 3 cars.

I have rung our councilor to arrange a meeting to discuss the situation, but she hasn't replied yet. Any idea on where i stand on this?

    Even if you parked illegally there is a duty of care that the workmen have to take. Let's say I park on a double yellow to use a cashpoint and another motorist crashed into me. They cannot be exonerated from blame because of my illegal act if there was reasonable room to get around my car. I would still persue it.

    I would have NO issue if I had received prior warning.

    I have spoken to our local councilor who says that parking there constitutes as highway, so is allowed no problem. The fact was I was in (working in the study) but would have heard the doorbell no problem if they had come and asked me to move it.

    Like viking said they have a duty of care, just because a car is illegally parked does not mean you are not liable for any damage caused to it.
