can a house be mis sold

I bought a flat in a Victorian house, that had just been converted into flats and an extension added at the rear. After receiving the completion and fit for occupancy certificates from the council, (apr.2006 we bought aug.2006), we went ahead with the purchase. This year the extension has had a survey carried out because of structural defects, it showed one side of the extension was built on an exsisting garden wall with no foundations, and the roof is pushing the wall apart, the whole extension was built on two soak aways which Thanet district council admits it knew about, but didn’t inspect before work was allowed to continue, the extension is now subsiding. The council admits liability and are prepared to pay for under the pinning, but houses are like people there not so flexible when they get older. Since the survey the freeholder claims he is no longer the freeholder, he is incidentally also the developer, which he also now claims not to be,( although he lived on site during the work). Can I be compensated, we are verging on criminal goings on here after all, and the council certificates are not worth the paper they are written on.

    If you had had a survey carried out before purchase, either you would claim against the surveyor for not identifying the faults (if apparent) or you would be able to claim on your building insurance.

    I would start with your building insurance (as you are a leasehold flat, I am assuming there is one policy for the block and you all pay towards it from your service charge or leasehold agreement. The insurer can then counter claim off the council, if they can show the council were negligent.

    I think the OP is concerned about the activities of the freeholder who is now claiming he is not the freeholder!

    I'm not certain what you can do about this. You could check with the Land Registry and see who they think owns the freehold.

  • the insurers say the insurance has not been renewed since last may which I also know is illigal the management firm will not give us details of the new freeholder,if indeed there is a new one
