The good thing is that as you've been under PAYE for the year the likelihood is that no tax will have been due by 31 January 2009 the penalty will be reduced to nil.
I've not used the HMRC website to lodge a return but it looks pretty easy. I would still write and complain about the mixed messages they've given you though!

ok cool, but won't they still make me pay the fine if i do that? happy to do the return as it won't take long, i just don't want to pay a fine for somehting i didnt have to do._____________________________________________

As I said above, the way to overturn the penalty is to file the return! If the tax due on the return is nil (which it will be if you were under PAYE), then the penalty will be reduced to nil!£705,000 raised by client groups in the past 18 mths :beer:0

after i sent my last return. just spoke to them and they said its becuase they set up the system so i'd have to do another one before the due date for submission for the last one which means the system makes me do it (even though somehow they also said i didnt have to).

This situation has occurred so often a conspiracy theorist would immediately deduce it was deliberate.
The notices to file a tax return were generally issued on the 6th April last year although they were actually posted over a period of a few weeks.
A fair number of letters were sent out in May and June stating that tax returns would not be required in the future.
These letters did not mean that the 2007/08 returns would not be required as the notices had already been issued. A lot of people have been caught out by this. Of course, a good number would have no tax to pay in any case so the penalty would be reduced to nil but it was definitely very confusing to the average taxpayer.If it’s not important to you, don’t consume it0
