Help!!! Someone used my card details to buy things online.

I sometimes use an online shop called Play.com to order DVD's etc online. On creating an account you have to provide your credit/debit card details.
I recently checked my bank statement and found 3 transactions to Play.com (£250 total) which i didn't order. I rang them and they said they had noticed fraudulant activity on my account and suspended it. However that the goods had been dispatched and payment taken so for a refund i would have to call my bank.
So I called Natwest and they started a fraud investigation.
Today i got a letter saying that because i had previously used the retailer before and given them my card details that it was an issue between me and play.com and the bank isn't liable.
Does anyone know where i stand on this??? Because Play.com say that the bank is liable and Natwest say Play.com are..
I really can't afford to lose £250 at the moment.

Play.com are responsible for this, not your bank. If they have sent the goods, then they must know who've they've sent the goods to. Ask them for this information if you can't see it online, prove you don't reside at that address and take it fromm there...If it looks like a duck, and quacks like a duck, we have at least to consider the possibility that we have a small aquatic bird of the family anatidae on our hands

Did Play.com say where they delivered the items to ? if local maybe you could pop around0

Phone Play.com and get them to take this seriously! If they have dispatched the items, then they will have a record of what address they sent them to.
I thought your card details would only work for the address you register, so if you want to send to another address, you have to re-enter the card details?? (it's like that on amazon...)Should've = Should HAVE (not 'of')

Your card issuer should be taking this up. Your card has been fraudulently misused
In such situations you will find that you cant even report it to the police as its now up to the credit card company to do so (Fraud Act 2006)

You also might want to check you haven't got any viruses/trojans/keyloggers etc on your computer.0

Its still fraudulent use of a credit card.
In a recent case where thousands of credit card details were stolen from TK Maxx. the people who's cards were fraudulently used still had to complain to the credit card issuer. Its up to them to take it further as I said the OP cant even complain to the police its up to the card company to do so.
I don't disagree, it's definitely a grey area, but as the bank said the details were given to Play.com and it was this account that was hacked. Unfortunately for the OP I think this grey area will cause a lot of difficulty when it comes to who finally sorts it out!0 -
To the OP I suggest writing back to the bank further disputing this transaction also mention you wish to invoke the banks complaints procedure. You have to do this if you need to take it further to the banking Ombudsman
I would also refer them to the Distance Selling Regulations which gives protection from fraudulent use of a credit card.
