Is a refund possible for 'no signature' on Royal Mail Special Delivery?

Does anyone know the legal situation regarding Royal Mail not getting a signature on a letter sent by Special Delivery or Recorded Delivery?
The contents of a letter I wanted to send had no intrinsic value (just paper) but I wanted to get proof of receipt so I sent it by Special Delivery. I don't know if the letter was received (it possibly was) but no signature was made available on the Royal Mail website. I then sent Royal Mail a letter requesting a signature, but they wrote back to say that no signature was available.
I then made a compensation claim using the forms they provide on their website. I simply claimed the £4.60 cost of sending. I got a letter back from them saying that they had tried to contact the addressee but had no response; and that therefore they assumed that the letter had been delivered and that I would get no refund.
This is a matter of principle. I'm sick to the teeth of postmen not getting signatures, both for stuff I send and stuff I receive. I have therefore sent them a Notice Before Action, warning them that they have broken their contract with me and that I will make a claim for the £4.60 in the Small Claims Court.
Do I have any chance of winning?

Ok...but where on their website or T&C's do they actually say that they are liable to compensate you in a situation where the item MAY have actually been delivered but that no signature was obtained? In my case, the addressee is not cooperating to say if they received the item or not and Royal Mail are refusing to compensate me.
I either need to know if the general law applies to give me the right of a refund or if there is a specific Royal Mail T&C that I could rely on.0 -
