    no the only reasons of the judge refusing BR is you are not insolvent or havent took proper advice.

    you do not have to go into and iva and have that fail before applying for BR.

    if your debts are over £750 and your debts outweigh your assets your are infact insolvent so therefore are able to apply for BR.

    you maybe able to get the court costs for free if so then you will only have to pay £345 as the court costs will be waived if not then its £495. have a look at the sticky at the top for fee remission

    Thanks my debts are most definately over £750 and my only asset is my car which the finance company said they are going to come and reposess. What would happen if I get made bankrupt before they take the car? If I do get made bankrupt and they turn up to reposess it after can they just take it?

    Everyone has been so helpful on this forum - have been looking through posts and seen the geniune support that people have - it's amazing as I have found other forums to be very judgemental and quite agressive.
  • the car shortfall will still be included i think as its a debt you aquired before br but others in the know will be able to answer that if im wrong.

    yes they can just take the car as its theirs untill you finish the payments but any shortfall will go into the br pot even if its after br.

    Hi stoke girl - congrts on the birth of your baby. can I just ask are you on official maternity leave at the moment? If so i don't believe you are claiming the correct benefits. You could be claiming working tax credits while on maternity leave as well as child tax credits (that you should be getting already alongside child benefit).

    OR.. just to be more akward - I have seen a job at my local high school as a PA to the Headteacher - that pays £21 000 - £24 000/ year and means I would probably have to return to work sooner (I have no issue with this as I have been off since November 2008 - was on SSP before my maternity as had a bad pregnancy due to high blood pressure, panic attacks - having your partner leave you and having your home repossessed when you are 8 months pregnant is not fun!!) but if I was sucessful at getting this job - would I just be working to pay off my creditors as an IPA would definately be enforced then, so am I best staying at my current job and working part time where an IPA probably wouldn't be enforced. But then again if I don't have a car I don't think I'd be able to get to work - But if I am sucessful at passing the interview for my local school - would they run a credit check and reject me because I'm BR!!!

    I've just realised how much I've babbled on and probably not made any sense but my head is hurting so much - I'm worrying not just about repaying my debts now but the consequences of me going bankrupt. My career background has always been in a admin / finance. HR /Payroll Officer, Credit Control Team Leader, Admin Manager and now I'm worried that i won't be able to ever get a job in those sectors again because they're regulated by the FSA and I'd fail a credit check.

    Oh and I've just applied for a Co-op Cashminder account and had it refered, so it's not looking too good. i currently have a HSBC current account (Overdraft and Loan with them will be included in my BR) and a Natwest Current account - no problems with them. Has anyone been know to keep their Natwest Account after going BR??

    One thing though - MA isn't counted as income for WTC (I was told) so have you told them your correct earnings for this tax year or did you include the MA.

    MA also isn't counted as income for LHA either so if you decide to rent privately you may find you are not as badly off initially as you thought you might be.

    I haven't included MA in either application so my figures are roughly correct, when i rang up about LHA they said that I would qualify for approx £93/week based on wtc/ctc being £52 that does get me an ok-ish place but am struggling because everyone wants to do a credit check. If I was to get a place and then go BR - does the OR inform my LL?

    can't advise on bankruptcy stuff i'm afraid but also wanted to say that your 09/10 income figures may mean you are elibible for the income related maternity grant of £500.00(?) as well as milk/veg vouchers (although tax credits may take you outside of the 15k entitlement level). I dont think you qualify before 09/10 tax yr though but I would check.

    You have to apply for mat grant before baby is 3 mths though so it may be just outside that time scale for you.

    In answer to one of your previous questions yes if you inform inland revenue about you change in income they will reassess your tax credits try going to www.entitledto.com for info on poss entitlements.

    Well it's day 2 of trying to sort my life out. Still too scared to open all of my letters that I have hidden in a drawer unopened - does this make me sound stupid?? But I have taken positive steps to sorting out my working and child tax credits so that I have a better idea of what my "income" will be. I also paid £2 to get my credit file (I had a 30 day free trial about 18 months ago so didn't want to try it again and get charged) I also rang for an application pack for a job closer to home as it doesn't look like I'll be able to travel to my old work once my car has gone as it is 20 miles down the motorway, but does anyone know if I'm likely to credit checked - it's as a PA for a headteacher so there's nothing in the job related to the FSA but everyone seems to want to credit check you now.

    hello, someone mentioned earlier about LHA for privatly renting, my current situation, is i have missed one month mortgage and secured loan, and saving up for going bankrupt and a deposit for renting, i have two young daughters, and so i want to get things sorted asap, if i go into rented acc do u know what qualifies for this LHA?? is this housing benefits or is it a different thing when u private rent??

    Day 3 - Big Steps taken today!!!

    Collated all my paperwork together today and I am finally opening the letters (In between lurking on here)

    I have also recieved the application pack for the job that I enquired about on Monday and state that they will run a criminal check but nothing about a credit check - this sounds like a really stupid question but will my house being reposessed show up on that?

    Hi Kebab29 - Best thing is for you to contact your local council re LHA and they can tell you if qualify and how much for but beware - I called mine 3 times and had 3 different amounts quoted to me, I checked on the online calculator and got another 2 amounts. In the end I went onto the DWP advisors website and worked it out manually myself, I then got this figure confirmed with the council and I was right. If you get no joy with your council, I can tell you how I worked out mine.
