Ticket not on dash - £50 fine!

I have just been to my local shops and parked in the council run car park. I purchased my ticket and put it on the back window of my van. I usually park with the front against a fence and have always put the ticket on the back for ease of view. I parked the other way round today and they gave me a ticket for not displaying the ticke on the dashboard. I must admit it does say to display the ticket on the dash but I have never noticed this before. When we returned to the van a very irrate lady was waiting for us to tell us what had happened. She said she told the warden when he was already writing the ticket that the he had missed the ticket as it was on the back but he didnt want to know. She was furious on our behalf because as she said 50% of the cars in the car park didnt have their tickets on the dash but mainly on the side windows. She told him he was discriminating against us and in that case he should ticket all of the other cars which of course he didnt. Does anyone know if there is anything we can do. I have taken phone pictures of other cars (not their reg) to send to the council to ask why us and not the other 50% of cars. Any help appreciated folks.

Hi there, I got a similar fine because a window was left slightly ajar and the ticket had blown onto the floor (was not the sticky kind). I wrote a letter explaining I had paid and it was an honest mistake and they let me off on this one off instance. Maybe if you explained you were trying to facilitate the inspection it may help.0

Supply the with a copy of the pay & display ticket & contact details of the witness. Explain exactly what happen, including the lady pointing out to the ticketer that it was displayed & I would of thought you will get let off.
If not, give it to the press...

What the ticket says is not so important as what the Off Street Parking Places Order (PPO) advises. This document will contain a legal definition of what the "relevant position" to display is. If it does not stipulate that the ticket must be displayed on the dashboard then it is not a contravention to display it where you did. Here is an example of how many PPO's define
"relevant position" means:(a) in the case of a vehicle fitted with a front windscreen, the permit or ticket is exhibited thereon with the obverse side facing forwards on the nearside of and immediately behind the windscreen;
(b) in the case of a vehicle not fitted with a front windscreen, the permit or ticket is exhibited in a conspicuous position on the front or the nearside of the vehicle;

Not sure that the wording on a P&D ticket will get a PCN cancelled unless the ticket contradicts the PPO. For example, the P&D ticket says "display on dashboard" but the PPO says the P&D ticket must be "displayed on the windscreen" as the example above did. It would be unfair to issue a PCN because a person followed the instruction on the P&D ticket.
I'm hoping the relevant PPO in this case either does not say "dashboard" or does not restrict display to only the dashboard but say, it may amongst other options, be displayed in a conspicuous position.
I would ask for a copy of the CEO's log book and all photos. Hopefully there will be a photo of the back window with your valid ticket or the CEO's log book will fail to say that all windows were checked.

Same thing happened to my son,the movement of the car door must have dislodged it from the dash. He appealed,produced the ticket, and got off.0
