    That's down to each individual company. There has to be a cut off point between a replacement or repair. You can't expect to have to have a repair on a week old item just as you can't expect a replacement on an item that's 3 months old.

    From the Argos website:
    If there's a fault with the product...


    We've made it easier!
    • If you bring it back to us within 30 days with your proof of purchase*, we'll give you a
      replacement or a refund.
    • If you've had the product for up to 1 year, we'll repair the product or, if that's not possible, give you a replacement or, if that's not possible, a refund.
    • Please note that all large kitchen appliances are excluded from our 30 day guarantee, but if your item develops a fault within 30 days, call us on 0845 640 0800 and one of our agents will assist you with your problem. If faulty and if it cannot be repaired we will arrange a replacement free of charge or you can opt for a refund.
    • This does not affect your statutory rights.

    Exactly its not written down in law just like i said , just because Argos say 30 days doesn't mean its the law and you have to accept it ,you are misinforming people.

    The 30 days issue would seem to be irrelevant anyway as the OP said they had it two weeks then took it back a week later...even my maths doesn't get 30 days

    The reason they sent it away in the first place was to determine if it was accidental damage or a manufacturers defect. They need this information to decide if the OP should get a replacement.

    I was just trying to explain where the 30 day thing came from

    I beg to differ they don't. .. The phone did not conform to contract. There was no evidence of physical damage and it they did not even conform to their own rules of 30 days. The law states "reasonable time"

    We can only go on the information as given by the OP in which case the company should have refunded if required or replaced

    It did show classic signs of physical damage. And just because there were no marks or scratches doesn't mean it hasn't been dropped. It could also have been sat on.
