    Very true, but I dont want to divulge on here. As I work at the same place as my wife. And its a question regarding my wifes position at the company..

    Went to the CAB and they weren't sure about my question, and we don't have a union at work or are part of one...

    But my question has to do with TUPE and reloaction...

    I'm not an expert, but I think this will partly depend on what the contract with the original company says - if it specifies that there is a given place of work, or if there is a 'mobility' clause in it.

    If as the result of a transfer you find that you are in a considerably worse situation than you were before as a result of being expected to work in a different location, then I think that this may count as possible constructive dismissal.

    The transfer is from the South of England to Scotland. So the distance is just absurd and in no way a possibility..

  • Actually, it's more the way the mobility clause is actioned which is crucial, rather than the distance concerned, but as it is connected with TUPE it strengthens the position, you will not be able to give enough information via PM, or even the forum to get reliable advice. Speak to the CAB about sourcing legal assistance.
