    Thanks everyone for your views. After all is said and done, and reading everyone's input (and trying to be unbiased) I'm still left with the feeling that the LL has taken unfair advantage, having them pay out for damage that wasn't their fault - they've taken the kids money for something that they normally would have the cost of repairing. Doesn't improve my view of LL's one little bit.

    But the LL has been left with a damaged property and it's not his fault either.

    An insurance claim might have been an option, but it's probably too late now. A claim against the upstairs tenant might also have been an option, but again - probably too late now.

    The damage occurred whilst the property was under the care and occupation of "the kids". I'm sorry, but it really is time that they "grew up" in the sense that they need to take a responsible attitude to other people's property.

    It really is incredibly rude to (a) not say anything at the time and (b) not say anything when they moved out.

    All that said, the "no cost" option of having this resolved is to let the tenancy deposit scheme rule on it, so they should raise a dispute.

    Hopefully, they've learned a valuable lesson which could stand them in good stead, in the future.

    the only person here who has been taken advantage of is the LL - whose property was in the care of the tenants who had a legal duty to inform the LL at the earliest opportunity of any repairs - they DID NOT - the responsibility for the repair cost is down to them - if you as an adult namby pamby them and tell them "its not their fault" they will never grow up and accept responsibility for their lives
