Company changing their mind

I bought a computer part from a certain company which from day one was faulty but I did not notice because I thought it was normal for the part to make noise. 7 months then passed and the signs where slightly more obvious the sound from the part was something you'd expect to hear from a car motor.

I told the company I was not happy. They said send it back and we'll issue you a refund but you have to pay to send it back so I did now I got an email saying it has been sent for repair, although they told me originally it will be refundable. They also said they can say whatever they like but if it is stated differently in their Terms and conditions they will not go and do it, can a company really do that?

They cant prove to me that they said it will not be refundable, but I never asked for it to be repaired. They didnt tell me it will not be refundable until I sent it back and without any warning they sent it for repairs. They are sitcking by their Terms and Conditions alot even though they dont specifically say what they tell me they are saying. I cannot find anywhere that says something like " If item is sent back faulty within the warranty time then we cant issue a refund". I have a 1 year manufactor warranty which I still have 5 months remaining.

Any ideas what I can do in getting my money back and not a repair.

    The retailer has to offer a repair, replacement or refund, but it is their choice which one. With electrical equipment, the majority of companies will repair. It is very rare for a refund to be offered at this stage.

    If they have offered something further, you must prove it.

    If it was within 6 months you'd have a better arguement, but seeing that it is after, the company has every right to repair the component (up to three times) before they have to offer a replacement/refund...
    If it looks like a duck, and quacks like a duck, we have at least to consider the possibility that we have a small aquatic bird of the family anatidae on our hands

    Ive waited 2 weeks and a half for the replacement how long do they have?

    Throw us a bone!

    At least tell us what it was and who the comapny is.

    If it's a poxy CPU Fan we shouldn't be bothering to reply to this question, if it's a hard drive we may have some advice or opinions.

    The company is called MicroDirect and it was over a PSU not CPU Fan.
