    If you have ever been arrested, cautioned or convicted then you should apply for a Visa to enter the US. Just because a conviction is regarded as "spent" here doesnt mean anything when applying to US.

    Do fingerprints not only get taken for major arrests ? (murder etc).

    I wouldnt have thought fingerprints get taken for possesion of cannabis which would therefore mean if the US people stopped you then investigated there would be no trace of fingerprints.


    UK National DNA database holds more than just fingerprints on everyone who's been held in police custody. Its the largest database held by any country.

  • If like Lynds says they do not have access to our info then the finger prints cant be linked?
    I thought this was incase you commit any crime etc while you are there, they can find you and identify you easier?

    This poster is suggesting that you "withold" information - guess what? If they found out you did not disclose a criminal record you will suffer far more serious consequences (especially since 9/11) that you are committing fraud to obtain entry!

    My Advise - don't listen to people who may have "got away with it in the past" ask the people who matter to avoid dissapointment.

    Here's another point - in the UK there is The Rehabilitation of Offenders Act that allowd you to say you have a clean record - well heres the point that I have to make to most people during my work, you are travelling to USA and any British law is irellevant The US might not have access to PNC records (Police National Computer) or any other official records (Data Prtotection Act prevents "sharing" of information) but Court Records/Newspaper reports/Crime Statistics are all "public accessable" and whats stopping the USCIS (Customs/Immigration service) checking any court record to see if you had a convicton

  • This is the thing you could of been arrested for a number of things though on the actual form it only asks about moral turpitude or subistance abuse therfore a lot of people could honestly answer no to what the VWP asks though if you look around the subject that is when it says anyway who has been arrested is ADVISED to get a visa!
