Hi there fellow moneysavers :-)
I would very much appreciate if anyone with knowledge in consumer rights could give me any advice on the following incident:
Last April my boyfriend bought me a 'refurbished' MP3 player from a London store. It came with a six month warranty. It broke within the first 4 months and he took it back to the store and they sent it to the manufacturer. The manufacturer couldn't fix it, but sent a replacement (refurbished) MP3 player to the shop, where my boyfriend went collect the item. When he got home, he realised that the charger cable was missing. The player didn't switch on as the battery was obviously completely empty. He contacted the shop immediately and they said they would sent the charger by post. After another week or so my boyfriend called the shop again as the charger hadn't arrived - they had forgitten... A few days later (c. 2 weeks after receiving the replacement MP3 player) the charger arrived and we tried to test the appliance - as soon as it switched on we could see that the screen was broken inside. Again, we contacted the shop. They claimed that they had tested the appliance before handing it out to us and that it was working fully at that point. We have been fighting about this now for over 5 months and they are refusing to replace the item or give us a replacement. We have challenged them about checking the appliance, as the battery was totally dead when we first got the replacement item - how could they have tested it with the battery totally dead...? Also, the charger cable was missing, so somebody must have been in a hurry and/or not very careful!
The latest is that we went to the shop and I insisted on talking to the duty manager who promised to get in touch with me, but made no promises about being able to halp me. This was now over 2 weeks ago and I'VE HAD ENOUGH!!! Is there anything I can do? I don't think the shop has acted reasonably. I would really appreciate if anyone has any ideas on how to get them to take responsibility over this.
