stuck here as guarantor has ccjs!!

hi all.im sooo fed up this morning and have hardly slept.we applied with a different agent to who we are with now for a property.we paid 172 pounds for our references etc.these came back fine apparently but the new agent rang yesterday to say our guarantor isnt acceptable as she has ccjs so now we are stuck here.dont know why they need a guarantor as they have received a reference from agency we are with who stated that we are good paying tenants but because we get housing benefit i assume this is why altho we never needed one for the property we are in at present.neighbours have been a nightmare with selling drugs,constant knocking at their door day and night and rows.ive totally had enough and now feel stuck in a huge rut!we have 2 children and i really dont want them being raised here .hubby going bankrupt in april so this was our chance to get away.has anyone else been through this??

It is pretty standard where I am to ask HB tennants to get a guarentor, however we clearly state the policy of CCJs.
It seems to me like you might be in an impossible situation because it the tennant was credit checked and was honest that they had a CCJ, and it came up on the credit report, you could have then been asked to get a guarentor. Its bad luck that the person you were suggesting could pay your rent if you couldn,t has been taken to court for not paying debts already.
Do you have another person you could ask to be guarentor, who doesnt have any CCJS? The letting agent would be a real meanie if they wouldn't let you use someone else. However you will be required to pay the extra admin fees for this. If you dont have anyone else, I am affraid they are probably not going to budge on the issue.Debt free since July 2013! Woo hoo! The bank actually laughed when I said I have come in to cancel my overdraft.0 -
thankyou for your reply hellokitty08.we have noone else to ask so unfortunately we cant move.such a shame as we have never missed a rent payment and normally pay it 2 days early and the reference from our current letting agent suggests this but at the end of the day-no guarantor means no move for us.i just wish we had somehow checked the area out and the neighbours more before we chose to live here .we did visit the road many times before committing to this house and it was always ok but it must have been days that our neighbours had run out of drugs to sell lol0

I do sympathise with your situation but you can't blame the LA/LL for wanting to be sure the rent will be paid.
The fact that your husband is facing bankruptcy soon does seem to affirm their insistance on a reliable guarantor.0
