    So in the space of two hours and twelve minutes you've gone from knowing about your insurance, to suddenly knowing about everybody's insurance. Impressive.

    Other than showing everyone that you're incapable of shopping around to find a cheaper premium, you're proving very little here.

    So in your world insurance costs have fallen over the last 10 years or so?

    See self serving personal accident lawyers forcing up premiums in reality.

    I'm very sorry for your commments Horace, i wasn't with my mother at the time of the incident. I was, however down there last night with friends and pointed it out to them. They thought that there was a danger and to contact the solicitor asap. That is the same opinion now of some fifteen people.

    Before you shoot your bolt, my mother is well aware of the pictures of her are on this forum - I took them with her knowledge, would you like my phone number to check - Maybe you can speak to her and give some words of wisdom? She is quite happy for people to see that damage that has been done and to gather advice from people of this forum. She is well aware that maintenance should be carried out after all it's what we all pay for to be put in place doesn't it. What would you do if it happened to you?

    You mention ''casting aspertions'' well some of the comments on here are pretty below the belt i think.... That is my opinion, that is all. Please don't try to make an arguement with the community because if you really analyze the comments posted then there really hasn't been many decent suggestions, apart from the many few. [You know who you are]

    I'm not racist, i havn't even mentioned it, so please don't try to paint me with your tarnished brush. I can understand people can go out, set something up and claim the rewards this is not the case. We are trying to bring it to peoples attension and make a change. If the whole world didn't bother doing things to stop this thing happening then what is really the point living in a world where no one cares and no one does anything about it. I thought thats what the point of these places are - Help, Guidance and Advice.

    May be we should all chill out a bit as MSE is not about insulting each other, its about helping each other.

    There is no doubt that everyone on here feels sorry for your mother, she has sustained some nasty injuries.

    You have asked for professional advice and you have been advised by a number of us that the law defines a tripping hazard to be 1 inch. There is no dount that the law is not always right on this but its how the law works. It works on previous precidents.

    The best thing you can do is take your friends advice and speak to a solicitor and see what they say.

    If your mother has home insurance it will almost certainly include Free Legal Advice 24 hours. If you look in her policy the number is normally by the number to make a claim. If you give them a ring they will be able to confirm whether or not she has a case, if she has legal expense cover they may even take it on if they feel she has a more than 51% chance of winning.

    So basically the best thing on this thread is we all stop arguing and for you to take your friends' advice and get some legal advice.

    Sorry, photos of water grate cover and your mums injuruies does not = "clear as daylight what happened". People do sometimes "find" hazards after an accident so they can alladge blame.

    Even if the gap was more than an inch, the council or water authority may be able to demonstrate a maintenance regime and therefore demonstrate they have taken reasonable precautions.

    You started this thread asking for advice - now you state someone is to blame. You may find that the outcome of a claim apportions some or all of the blame on your mum...

    I really feel sorry for your mother but have to echo the other comments on here that sometimes accidents just happen and it is not anyone's fault.

    I am a (defendant!) personal injury lawyer and based on the information provided I do not think that your mother has a claim.

    However, if you do chose to proceed with a claim please do not use Thompsons who were linked in a previous post (although the user did not say to use them). They are the type of firm that give personal injury lawyers a bad name.

    You should also consider the fact that your mother is not likely to get much money. Is it really worth all the hassle of making a claim? And a claim like this would almost certainly be defendant and your mother would have to attend Court.

    If it is more about the principle than anything else perhaps just informing the Council of the accident would be enough?
