LA never protected deposit, what can we do???

My partner moved into a property prior to April 2007 but had paid her deposit scheme monthly due to being on benefits at the time, she was paying her deposit past April 2007 and she also signed tenancy renewals every 6 months and was charged £25 each time, and this took place after April 2007.
I have spoken to the LA and they have told me the deposit is not in a government backed deposit scheme. I believe we can take them to court to reclaim 3 times the amount of the deposit is this correct and if so what form do we need to get from the courts?
The LL has stated he wants every carpet and the walls in every room re-painting even though the LA could not tell me if there was damage to the walls and they have not even attempted to get the carpets cleaned, as my partner couldn't due to there being a problem with the electrics in the property at the time.
The LA has not got back to her for over 30 days after moving out to discuss what deposit is due, and I believe this should have been done within 10 days of moving out.
We also want to get all the information on file regarding issue's with the property, would we go down DPA 1998 Act or FOI 2000 Act ?
