Deposit Problem - please help

In 2007 I moved out of a house I was sharing a couple. They moved into another house and I moved in with someone else. The deposit was refunded to one half of the couple. For the past 2 years I have been asking for my share and to no avail. I contacted the estate agents who gave the amount of money I was due and also gave me information on when the deposit cheque was banked etc. I gave these details to my former flatmates and now they are saying that the cheque was never banked and that they have bank statements to prove it. Who should I believe? and if I take this to small claims who do I ask for the money from. The estate agents or my former flatmate? Because of Data Protection there is no way I can prove who has the money. My former flatmate says he is talking to the estate agents but I have no idea if this is true.

    The first question would be why have you let this carry on for two years?
  • Well to begin with I didnt see the couple much and we always said ill give you a cheque next time they see you. Then it was ill give a cheque to your flatmate when I see him. Then I moved again and had my own troubles being made redundant etc so it took a back seat - they have never refused the fact that I an owed but its taken an unexpected turn
