    You should not be phone free legal aid. You should be phoning your own insurance policy's legal department. Your own insurance company do offer free legal advice.

    All insurance policy's come with an excess. If my car window was broken by my sons football. I would still have to pay the excess regardless of who caused the accident as I was the one who made the claim.

    I think this small claims business is just a threat. As he has told you he does not have the support of his insurance company. What makes him believe you owe him or that he can legally win.

    Talk to your insurance company! You need their reassurance or visit the CAB. Free half an hour with a solicitor even.

    Did you install the washing machine yourself? If not any claim for incorrect fitting of the machine causing the leak should be directed to the person who actually installed it.

    Thanks, i bought the kitchen from Wickes and i used one of their "recommended" fitters to do all the work. I have their insurance details which i will pass onto the insurance company if they want them.

    Thanks again for your advice.

    I would do that. If you did not personally fit it then absolutely no liability should attach to yourself for any damage caused.
