Extremely worried over old rear extension !

    The house I'm buying has the same, an extension built 30+ years ago without planning permission. The sellers are paying for indemnity insurance. No big deal and it didn't put me off one bit.

    I bought a house that had had work done years ago with no building regs consent. My solicitor (who was very good) insisted that the vendor took out an indemnity policy, which they did. This bears out what has been said by Doozergirl and Richard (they are both very knowledgeable) previously. The indemnity policy was not expensive, just over £100 I think it was. Not much in the scheme of things when someone is buying your house. I honestly would not worry about it.

    I agree with the above - it's not a problem. A simple indemnity policy will suffice.

    My extension isn't on land registry plans and it was all done legit.

    I wasn't scaremongering, that wasn't my intention at all, I was just telling it as I believed the case to be and to try and avoid any hiccups when selling in the future, if potential buyers were put off by the extension not having planning permission and wondering why.

    There was some sense in what you had to say around talking to the planners but I'd just urge you to remember that there are real people behind the posts here. If you believe something without any real knowledge to back it up then it's always better to say 'i think' rather than outright confirm somebody's worst fears. I'm sorry if I was harsh.

    With regards to the land registry issue, just wanted to say that we're just selling. Our house was built 14 years ago and still doesn't show on the land registry plans apparently, our solicitor also said this is totally normal they only update every 20 years or so.

    Thank you so much for your help on this issue guys - it really is helping to put my mind at rest. I only wish I'd found this website years ago! Whilst at the moment we have no plans to sell, if that time does come then at least I'll be prepared. Just a thought though (sorry, to be a pain once again) if we had a problem with our extension, would we will be able to claim through our buildings insurance, or would this be a total no-no?

    If it just fell down then questions might be asked about it's structure and if you knew there were no PP or BC then you might have problems.

    Poor old Mags, dont worry, there really isnt a problem. When/if you come sell I believe you are asked whether there are any building works in the last five years. You can truthfully say no. :) Relax

    Have to say, Land Registry - last time, the bloke who came to update maybe 15 years back, met my OH on our driveway, said is there anything different out the back, OH said a few sheds and the bloke said thanks and walked off without even looking out there :)
