help. joint account problem

my husband and i are now seperating and im leaving our property in next couple of weeks.

But checking our joint account yesterday he has emptied it taking it to the limit on the overdraft.

After lots of arguing about it he basically doesnt care that he has now left us £1400 in debt. and that i have no money for the rest of the month for me and our child.

What can i do as im only going to be on income support to start with until i can find a job. the interest each month on that is going to be about £15. i will be lucky to be able to pay that without adding more to clear it.

plus other debts he has left me to sort

i also have another bank account with the same bank. will they close my accounts if i phone their helpline re paying above back, as i really do need to have a bank account and i havent got another one.

    I'm vewry sorry to here about your troubles.

    You need to open a new bank a/c asap with a different bank and one that you have no debts to and make sure all your income is paid in there.... otherwise the bank will simply take any income.

    Once your income is tranferrerd to a new bank, then you must speak to the existing bank and freeze the joint a/c to stop your husband withdrawing any more money.

    I would suggest posting on the debt free wannabe board... they are a very supportive lot over there.

    Before you do anything get your money out quickly so you have money to live on and open another account with a new unrelated( to any of the debts not just bank) institution.

    If you phone they can just take any money you have.

    On any joint accounts you are both still liable so beware just taking them on and paying them you don't have to, if he has income they can still chase him.

    Other debts are only yours if you are the only account holder.
    what are they?

    Additional card holder on CC are not liable it is the main cardholder.

    Whats the situation with the house and mortgage? is that joint also.

    You need urgent advice so CAB is a good place to start.

    Also suggest advising bank of situation, that you will not be responsible for further debts on the account, and instructing them not to accept any orders to pay from the account unless they are accompanied by two signatures.

    Having looked at a couple of your previous posts, I would suggest that you speak to the CAB. To allow your ex not to pay maintenance so he can pay the mortgage on a house you and your child are not living in does not sound right to me.

    Do make sure you get professional advice, you have a child to care for.
