Insurance Claim Investigation

I had an accident a month ago, my side and another car colided at roundabout. They put claim under investigation but wouldnt let me talk to them only Policy holder my parent.

Now we got a letter asking for V5, and details of cars we have and who drives them, etc.

Car1 V5 in Husband name but main user is and therefore insured in Wife name
Son also insured (me)

Car 2 V5 in WIfe name but car Main policy holder Husband although both are nameed drivers on both policies.

I dont understand Why they want V5, details of who drives what car, how much, who main user etc :S

can anyone help? I asked dad to call and ask for legal assistant

    If you are the main user of the vehicle you were driving, use it most of the time, then having it insured in one of your parents names is a type of fraud called fronting. This is an old trick, and it can be easily spotted by a moderatly experienced handler, or/and a well set up computer system. It just so happens that your arranement displays some of the same charateristics.

    This is probably the reason why your insurer is investigating. They have a right to ask for information that will enable them to investigate the claim under your policy.

    It seems a bit odd that your parents own a car each but are the main drivers of the other's cars, but there you go. Provided they declared the true ownership at the inception of the policy - it is usualy asked - there should not be a problem.

    If you are genuinly only a named driver for the purpose of occasional use, and could support this by showing you regularly use alternative means of transport like the train or/and bus, and/or that your mother uses it mainly - e.g. for daily commuting - then you should be fine. It may take longer though and mean you need to complain to get though to management or get them to send a claims investigator out to talk to you and see your situation.

    They still want details of all the cars, etc. I dont mind them asking me direct wether I drive it regularly as I live away from home in week and I can support that.

    dogbot's post is a good analysis of :

    - why the Insurer is asking for more information, and if your parents use the cars during the week, and you have use only at the weekends, then I would think that getting that information to the Insurer is in your best interests.

    - why the query may also arise over who owns as opposed to who is insuring the vehicles - again getting the information to the Insurer is what you need to do.

    Matter of interest and perhaps importance - did the accident happen at a weekend?

    What does that prove?

    It could be away from home all the time thus making it even worse.

    They clearly suspect you of fronting and one can see why.

    What type of car is it? What proportion of the driving is done in it by you and the other driver?
