housing/council tax benefit-maintenance disregarded??

is it right that when claiming housing benefit and council tax benefit they no longer count maintenance for children in with your income??? on my claim in sept 08 they let me keep the first 15 pounds but took the rest into account when working it out and ive heard nothing from them to say its changed and my payments on housing benefit and council tax remain the same.

Yep, fully disregarded from Oct 08, can't recall what date though. I would have thought most Authorities would have implemented the change automatically. Try giving them a call to check what's going on?

So someone could have £300 a month in maintenance and it is not counted in the means test for rent and Council Tax Benefits? Is that correct?(AKA HRH_MUngo)

yes i assume this is the case.the council are too quick to take maintenance into account but havent heard from them regarding the change and had payments upped lol. i get 125 pounds a month for my daughter and was allowed to keep 15 of it so now surely they should have amended payments! typical of our local council!0

you are correct.
myself at this. esp if MS A [a random i have made up] claims and receives £250 a month EACH [making £750 a month maint.] of off the 3 blokes who fathered her 3 kids plus other benefits, its taking the !!!! IMHO to not have this taken into account. she wont be spending the money she is raking in from the 3 blokes for clothing and feeding her kids, she will be spending it on tacky jewellery for herself and booze and fags and plasma tvs and !!!! whilst everyone grafts hard [when they can] to pay their taxes to pay for her disgraceful lifestyle.
sorry for going off on a rant but i think this is a rediculous new rule.
why dont we just throw money at people in the street save them the angish of filling in a benefit application form.

If 'Mrs A' was in receipt of IS for being a lone parent then she would only be able to keep £20.00 of the maintenance money (in total, not from each father).
If she was getting HB and CTC for being on a low income then she would be working and so surely is entitled to spend her money how she wants?

This will really cheer you up then...from next year, lone parents who are on IS get to keep the full amount of their maintenance PLUS their IS. So whether someone is paying £20 or £200 a week, he full amount can get kept.

I too think it is taking the p and in fact I have started a thread on it.
Scenario 1. Couple, two children, £1000 a month income, none of it from maintenance. No Benefits.
Scenario 2. Couple, two children , £1000 a month income, including maintenance of £300 a month, their income is classed as £700, they get full CTB/HB.
SO not fair.

Most of the changes seem to be as a result of what people wanted from the csa - money going directly to children instead of being used to offset benefits.0
