    o- As other have said there is nothing in law which says what side they must be.

    o- From legal perspective its better to have the rail on the non owners side as if the fence falls over and damages someone/something you could be held accountable. Its more likely to full away from the rail.

    o- For security rails on your side.

    o- Its very likely if the rails are on your neighbours side you will need to move the posts to stop the fence approaching on their land.

    I always wondered if building a feather edge with arris rail, about doubling up the arris rails so you could board both sides so you both get a nice fence ?

    It would be a fair bit more expensive but would be very solid and every one should be happy with it ?

    .....I am aware it is not a legal requirement....you could always google it and see if you can get a definative answer.

  • I've never really understood why people worry about such petty things. My fence is rail side all the way round (3 sides) and I'll have to pay to replace them (as the neighbours certainly wont) so I'm going to have it which ever bloody way i want it!! Simple!

    No. But it's correct that the posts have to be wholly on your land. So making the 'smooth' side away from you - and correctly sited - means the outer edge of the smooth side should be the definitive boundary. If you do it the other way ..... you create a haphazard boundary line and make maintenance more difficult. As it tends to be the posts that need most maintenance.
    If you want to test the depth of the water .........don't use both feet !

    Was not trying to be rude or unhelpful. I've seen it way to many time where people say 'I read on the internet....' and then things go wrong. :(

    When I had new fences fitted, I had all the nice faces looking into my garden, except those that face towards the road. After all I'd paid for them. My neighbour had years without any fences before I moved in - so he clearly doesn't care.
