Letting agency- changing mind about reserved property

Hello
I am hoping someone can help me with this:
I have paid a letting agency an admin fee for my referencing e.t.c…I don’t actually sign the contract for a couple of weeks. The thing is, I have found another flat which I much prefer.
I don’t mind losing the referencing fee as the rent for the other place is at least £50 a month less so I’ll make up for that in a couple of months anyway (even with paying another fee for the new agency) and from then I’ll be even saving money.
I am worried that I might be taken to court for defaulting on the first place though? Can they legally do this? I haven’t signed anything except the referencing form and not signed a contract yet, all I have paid is the agency admin fee. Could I be placed on some sort of tenants’ ‘blacklist’? Would there be problems with referencing so shortly after the first one if they use the same referencing agency? Could this damage my credit record in any way (Apart from having two credit searches close together!)
Please help! I have no problem with losing the fee- just don't want to be taken to court!

I can't see that there would be any problem with it at all.
You haven't signed a tenancy agreement so there is no obligation for you to take the property.
I doubt they will put you on a 'blacklist'. If you want to keep on the right side of them for the future, just ring up and be all apologetic. Although they might think you're a bit of a pain at that moment, it will all be forgotten by next week and certainly by the time (if) you come to look for another property with them.'I can't deny the British influence on my accent and mannerisms, but I don't know the British national anthem, I didn't weep for Princess Diana and I always cheer when Britain loses at sport. That's how British I am' Constantine-Simms. :T

Sounds correct to me.

Our last letting agent wanted £150 each for 'credit checks and admin' - nice if you've got two tenants and a guarantor ...0
