Baliliff visited for year old parking fine, distress and lost

A Baliff visited my parents home this morning saying he had a "liability order" on their property to collect a fine for a parking ticket from feb 08 I knew nothing about. I havent got any letter or anything, but I do remeber correspinding with the council to find out if it was still outstanding after my car was towed in the same area, at the point I paid £360.

He was rude to my dad told him he would take stuff out the house and clamp my dads car.

Now the council said I have another ticket from Feb 08 and they dont care if I was given incorrect infomation of if I dindt know about it. The Baliff is demand £600 which I dont have, he told me to ask my friends and family and call him tomorrow and let him know how much I can get. I dont have anyone to bail me out.

When I called him he said because my dad lied and said he didnt know anything about the ticket or me, he, the baliff had reported to the council and I was in even bigger trouble because my father lied and there was some kind of liability order on their property?

Any help would be much apperciated?

I don't think they can do anything to your dad or your parents property. Its you that owes the money, they can only take your property and thats only if they have the right paperwork.

dacouch is correct, they can only take YOUR property in relation to any outstanding debts, not you fathers. If they did take something not belonging to you, it is theft, so if they were to take something belonging to someone else, call the police.

As to the tickets: have you physically seen them? If not, then I would advise you to request copies of them to ensure these are relating to you and not someone else. When you get the tickets, post them on here and one of the experts will be able to have a look at them and see if they are legal. If they can't gove you copies of the tickets, well, you can't have anything to pay...

it may be worth recording the bailiffs visit and remind him of the laws of demanding money with menaces...

Sounds like that bailiff is overstepping the mark.

Google Northampton TEC (issuer of the warrant). You will need to make an Out of Time Statutory Declaration. This will suspend bailiff action.
Inform the bailiff and Council when sent. Do this very quickly. Get countersigned(witnessed) at your local County Court for free.

Try and get to talk with TEC - they are normally helpful - BUT - unfortunately very short staffed at the moment.

You need to complete an Out of Time ....TODAY !!

I am very annoyed to hear that a bailiff is stating that they have a Liability Order against the property for an unpaid PARKING TICKET.

This is serious because a Liability Order is from the Magistrates Court for unpaid COUNCIL TAX which is a criminal offence and NOT for a parking ticket which is CIVIL.

I would seriously consider a letter of complaint about this to the local authority as they are wholly responsible for their agents.

Hi I have replied to your PM. Now both the LA and the bailiff company equita have sent me a letter. This is the first letter I have ever got from Equita. They are demanding £261.13 (which I dont have to pay), when the bailiff said £600???
