    No my partner is not with them, What happened I think is, When I first moved into my current house with my partner I'd just moved out of council property. (This council property is not the same address as the one I bought the car from, that was private rent) For some reason I ended up owing about £100 council tax benefit overpayment which was fair enough so I got the money together and paid it straight off. The thing is though, council tax office was sending the letters to my old (council) address. Obviously I haven't lived there in over 18 months so I wasn't even aware I owed anything. Then they passed it on to a debt collection agency, who found me probably since I am now paying full council Tax with my partner at this address. Why Council Tax could not find this out themselves before getting debt collecters involved is beyond me but there you go. I paid it and the extra charge put on by the agency.
    So I guess now that one debt collection agency have my details and know I am at this address the rest of them will do now.
    And I think the vodafone contract is probably just under 6 years :-(
    Worst case senario, if I do get a big scary 'YOU OWE US NOW!!!' letter in the next few weeks what the hell do I do? I am actully on Income support at the min will this help? And would they clear any of it off? Oh if only I could turn back time, I'd slap myself!! Thanks xx

    Look, you've nothing to be scared about, a debt is a civil matter not criminal, you've nothing to be scared about, if they find you, you pay what you can afford.

    As for the credit reference agencies, I wouldn't trust them with my details, after all, there funded by the financial instiutions.
    Also I have heard that if you owe a debt after 6 years from getting the loan it will be wiped?? Is there any truth in that in my case? Clutching at straws...

    What so if the date I last paid YES car credit was over 6 years ago they can't ask for payment?? Or do you mean vodafone? I can't exactly remember when it was but if I don't haer anything after the 6 years is it wiped?? Hope!!?

    yes car credit I meant. How much do you owe Vodafone?

    They will continue to look for payment you just have to send them letters stating it is statute bared etc

    I owe vodafone over £640 but I rang the debt collection place this morning who offered to halve it for me which they have done to just over £320. I don't even remember how much I owed on it in the first place so not sure what to make of that but I have agreed to pay £20 a month which isn't so bad, they were actully really nice on the phone but they can be very nasty as I found out when I was trying to find out about the council tax overpayment.
    Sorry I guess I'm a little ignorant to all this but what does statute barred mean? Sorry :o

    I have just worked it out and am pretty sure the vodafone was over 6 years ago! I have paid £20 this morning to the debt agency should I not have done this? I wonder if I shouldn't have paid it as it it over 6 years ago? I bet there is nothing I can do now is there? When I asked the guy on the phone how long ago it was from he just said he couldn't tell me, many moons ago I expect. Oh what have I done now?! Bet I can't do anything about it now I have made a payment can I?

    you would need evidence that the last payment was over 6 years ago. Plus paying today I think stopped the whole statute barred thing.

    Never deal over the phone

    EDIT: I know nothing about 'statute barred' other than the 6 years

    Once a debt is statute barred, it remains that way so making a payment today won't change anything. You won;t be able to get your £20 back though. Try googling 'statute barred debt' and you will find loads of info.

    IHTM28384 - Law relating to debts: statute-barred debts

    If a lender allows time to pass without receiving any payment an action for recovery may become barred.

    Under the Limitations Act 1980 the time limits are
    • in simple contracts, 6 years
    • in contracts under seal, 12 years.
    If the debtor acknowledges the debt in writing or makes a part payment within the original limitation period, then the time limits start to run again from the date of acknowledgement or the date of payment.

    Even though the lender may be barred from pursuing recovery, a debtor may decide to pay the debt after the expiry of the time limits. Because of this you should allow a debt which is otherwise statute-barred if the personal representatives pay the debt and you receive evidence that the payment has been made.

    Thanks for the info. But could you tell me how I go about finding out the date I made the last payment? And how do I find out if it's defo Statute Barred? Should I ring the debt collection agency and ask them? Although he said he didn't know, should I ask them for info on how to find out? How do I find out for sure? Your a great help thanks for your advice so far....
