Diamond fallen out of engagement ring - my rights please?

Is this a bad omen or just shoddy workmanship?....
Bought a lovely diamond engaement ring (certified stone) form 365 Diamonds in October. Good service etc , very happy with the ring etc. THEN...a couple of days ago the stone fell out of the setting, found it fortunately.
On Diamonds 365 website they have a 36 months refund policy for faulty items, all good then....BUT this is their get out clause on the website -
"Note: Due to the excellent skills of our diamond setters our diamonds will NOT fall out of our jewellery, they can only be dislodged. We therefore strongly recommend that you fully insure your diamond jewellery as loss of diamonds does not fall under the 365-diamond.com guarantee."
So apparently, although I only wear my ring for normal daytime activities, not when I'm cleaning, or in bed atc the stone has been 'dislodged' and so it must be my fault...!
But isn't it a faulty item if the diamond falls out? how can they say it's impossible for it to fall out unless I have done something myself to the ring?
Any advice please guys?

If it is within 6 months of purchase it is up to them to prove that you damaged the ring.
It's like a car manufacturer saying "Our cars NEVER break down so if it does it must be your fault"
Mind you in that paragraph it is talking about loss of the diamond, which isn't a problem for you as you've found it!0 -

Yep, but as I say that paragraph just states that they don't cover you if the diamond is lost, for which you should have your own insurance.
But, it looks like you'll have a fight on your hands to even get it re-seated. Never mind a refund / replacement.
Personally I would go to a different jewellery shop and get them to resit the diamond into the ring. I wouldn't risk sending it back to an online retailer, that kind of thing is just too important. Sure it'll cost you ...0
