Tenancy & Bankruptcy

We moved into a rented property 6 months ago, and having just become bankrupt, the tenancy was taken out by my partner with myself being a named occupant. At the time we paid a fee with the agent (yourmove) to get my name added as a named occupant.
We have recently renewed the lease for another 12 months, and the landlord has been made aware that i am a named occupant. The agent never let her know this and she is now demanding my name goes on the tenancy. If i do this i will need a credit search, which will mean my bankruptcy will show. There is a clause in the lease that the tenant shall not be or become bankrupt.
I am wondering what rights we have as the problem has been caused by the agent 'forgetting' to inform the landlord i am an occupant.

You now have another 12 month AST. Any arguement between the landlord and their agent is just that, it doesn't alter the fact that you have a 12 month AST. Neither part can take that away from you.
To smooth the waves you could write to the landlord and say that you went on as a named occupant as bankruptcy was looming so you thought that would be easier. That way leaves the landlord a route to accept things as they are and the landlord can decide if they want you as a tenant or occupant in a years time.I'm a Forum Ambassador on the housing, mortgages & student money saving boards.
