Cancelling the Letting Agreement

Hello

I hope somebody might be able to assist me with my enquiry.

I am renting a property through a private landlord (although I did go through an agency, I am paying the rent price directly to landlord's account). My 6 months initial contract expires within 1 month and the landlord proposed to extend it for another 12 months. I am not sure that I want to bind myself to this property for 12 months so I want to make sure I can cancel the contract. Our current terms state that we may cancel the agreement giving 1 month notice before the contract expires. Is it a normal condition? I was under impression that it is possible to cancel letting agreements providing the sufficient notice. Could you please advice? Thanks in advance!

    Presuming you are on a AST, At the end of the inital 6 mths you can leave on the the last day without giving any notice. If you plan do do this be very clear on date, because:- If you do nothing and stay 1 extra day your contract turns into a perodic contract, this means that you have to give 1 mnts notice and the LL 2 months. The notice must be given on or before a rent day. Your LL wants to get you to sign a new 12 mth contract, if you did you will be contratced for the 12 mths and will have to pay for all 12mths. If I was a signing a new 12mth contract I would want a discount. Just say to the LL that you are happy to go perodic as you are not sure how long you want to stay.

    I have a 6 month contract in scotland. The LA and contract states that I must give 2 months notice at the end of the 6 month contract. Is this correct or can I leave as long as I leave before the expiry date of the current 6 month contract?

    All I kown about Scotland is that it has some nice mountains!!
    Not a rent date, unless the rent date and the date in the month that the fixed term came to an end are the same (they often arent).

    My rent date has always been the same as the date the contract ends. Why would they be different.

    Many different reasons, I will leave it to your imagination.

    The key date is the date in the month the fixed term ends, not rent date. The date in the month the fixed term ended is the key date for service of notice. Its very important that you quote this date and not the rent date in responses, otherwise posters will be giving incorrect notice.
