Made Redundant

Hi,
My girlfriends dad is being made redundant. The workplace are paying him 3 months notice pay and redundancy pay, but he will not be there working for them anymore.
The company told him that he is not allowed to have a new job during those 3 months of notice or they can take the money away.
Are they allowed to do this. It basically means he will be at home for 3 months until he can start looking for a job.

It all depends - are they paying him in lieu of notice or simply putting him on garden leave for his 3 month notice period?
If they are paying in lieu then he should be able to seek work as his contract will be immediately terminated
If they are not paying in lieu then he is seeing his contract out so can't work anywhere else full time until the contract end date0 -
Provided they have followed due process then yes it is perfectly reasonable for a company to put an employee on 'garden leave' during the notice period. In cases of redundancy this is normal even if it isn't an explicit term within his contract.
Northern G is correct in that he should be employed for the full duration of his 3-month notice period as per usual until his final pay.
If this is not the case (unless their is a restrictive covenant within his contract) then it is lkely to be unlawful and I would suggest he contacts CAB.0 -
Why is it a big problem? If he is being paid his normal salary for those three months, then it gives him more freedom to job hunt and attend interviews, ready to start his new job when the three months are up.0
