advice needed!!

I was at work thursday when i was called into the office for "a word"! I was then sat down to be told that i was at risk of redundancy (the only one in the whole factory) that I should leave the factory immediately!! I was absolutely gobsmacked, I was told I didnt need to make notes but I walked out of there thinking I was redundant until I received a letter 2 days later to advise me I am " at risk" and need to go back to work in 2 weeks for a meeting!! I am furious that they can treat me in this way, it feels like I have done something wrong to not be working while they sort it out!!

Immediatley after my exit from the factory an announcement was made to the whole company that my job role and 4 others are no longer!! So this means they have definately decided that my job role is definately going before I even knew myself!!! I wondered why I was being made to leave straight away they obviously want me out the way!!

They have offered me 2 other positions which are the other side of the country AND as a national account manager ( I deal with quality issues) so obviously not suitable redeployment!!

There is somebody doing the same job role as myself on the other site we have and it has been announced that he will be doing both sites! (my job)
surely I should have been able to apply for this aswell!

do you agree this is a fair case of unfair dismissal?? I am going to see a solicitor next week but my mind is awash with worry!!

thanks in advance for reading

Thats what they are not allowed to do. without going through the process anyway.

There should be an internal scoring process to assess you against the other person to decide who stays/goes.

Most companies ask staff to go on gardening leave during the consultation period, you shouldn't consider it anything personal.

I do not take this personally however they have not done a scoring system.

I was called into a meeting ( 1st consultation meeting ) to be told i was at risk, also my job role was no longer. the same day a statement was read out at both sites confirming my position has gone. my role is being covered by the QA Manager at the other site.

I was put on garden leave to work my 2 week consultation. I am back in on the 12th march for another meeting.

In my letter it says they are open to alternatives which redundancy may be avoided but a decision has already been made and shared with the site after my exit of the site.

If they have made such statements then it sounds like they have no intention of carrying out a 'proper' consultation period. Any period of consultation should be meaningful consultation so if they have said your job has gone, then it sounds to me like they do not intend to fulfill their obligations. You should confirm what they have said though and be wary of Chinese whispers. At our company anyone 'at risk' were commonly referred to have left despite it not being official (not by management but by others as it's pretty much a formality).

My job role was made redundant recently so I sympathise with what you're going through.

Also I would get advice from ACAS as your position differed from mine as we had more than 20 redundancies (although if they've siad there's a consultation period then they should fulfill their responsibilities).

This is Identical to my circumstances, they made me leave at once and dispite telling me i'm in a consultation period have told suppliers i'm on garden leave!!!
They also asked me when leaving, to take any personel belongings, when I mentioned work boots they asked if they had supplied them, etc. I went back on monday to collect a stereo and the manager ask me if i'd found another job yet.

On one hand "on the record" they want to be transparent and on the other "off the record" it's goodbye.

Why would I want to work for them, answer I don't.

Good luck, and read up on the ACAS site
