Just wondered if anyone could help our tenancy ran out on 16th Feb our landlord has not come to us to renew in the meantime we have found a bigger and cheaper flat. I contacted the landlord to tell him we have decided to leave and he want us to give him 1 months notice from 16th March ( which we are paid up too)
Just wondered if anyone knows do we still have to give notice if our current contract has already expired? He has told me that even do it has expired we would still be under that contract surely this can't be right?

The terms of your original tenancy still apply as once the agreed tenancy period comes to an end it becomes a statutory periodic tenancy.

If you have paid rent up to 16th March then you need to serve notice in writing prior to the 17th March and you will be required to pay rent up to and leave by 16th April (assuming your rent is paid monthly and this mirrors the date your tenancy commenced and no adjustment was made for the rent due date).
It is a legal requirement that a tenant on a statutory period tenancy serves one months notice to end at the end of a rental period. If you stay one day beyond that date then another month's rent is due.0
