Help please!!!

Hi,

I resigned from my position as of 30th Jan, due to it being untenable as they asked me to do slightly illegal things, I had also heard whispers they were going bust from a friend, I had a job lined up to start but as part of my contract I was told to serve "gardening leave".. hence I can start my new position tomorrow, now last week I get a phone call from my friend saying they are def going bust so I ring them to see whats what... I'm told nothing to worry about I will still be getting my pay etc... so payday comes and no money paid in... I ring again to be told they have had to make redundancies and I should have recieved a letter informing me how to go about getting the money owed !!!!!

could someone tell me if this is normal practice? as to me it doesn't seem so....

    The thing that strikes me here is that you "resigned" - and I hope this doesnt mean the D.W.P. will impose a benefit disqualification on you for apparently leaving a job of your own free will.

    I can see you had no option but to leave - with the fact that you were asked to do illegal tasks. It would be wise for you to think about how to "cover your back" on that - ie is there any way you can provide yourself with proof that you were asked to do illegal tasks (I would have thought the D.W.P. wouldnt be able to expect a claimant to have been prepared to do anything illegal in order to stay in a job).

    So how much pay are you owed by this 'ex-employer'? Did they accept your resignation when you tendered it? What was your notice period?

    they accepted it and notice period was a month so owed a months wage....

    You haven't been made redudant if you handed in your notice, and it was accepted - you have resigned. Have you received your letter that your ex-employer said had been sent to you?

    Yes as I stated I resigned, however when I rang to see about my months pay as I was on garden leave I was told they had made me redudant and a letter was sent though this was never recieved, they now don't take my calls and trade under a different name....
