Bank charges lead to default.

I was arguing with Barclays bank about there bank charges and left my account £1000 which I believed was how much I was going to receive. This lead to a default which looking back should have been avoided by myself.

If the case is won does anyone think that I may get the default removed?

    Unless the bank charges the total amount that you were defaulted then no.

    I'm in a simliar position in that I have an o/d balance with Nationwide that is entirely made up of charges. It started withem charging me for a bounced dd, then the od created by the charges etc. I had also paid in the funds to cover the dd on the day it was due.

    Its now up to £250 so i'm claiming a total of £370 having gone back to when i opened it 2 years ago but they have now issued a default notice as theres no agreed o/d limit.

    I've written to them and the credit reference agencies saying they cant default on a disputed debt.
    Not sure if it will work but i'll keep you posted on any progress.

    I think that the amount I'm claiming is well over £1000, unfortunately I have changed computer and lost the letter that I sent to barclays bank. The default has been cleared by and full and final settlement.

    Big Steve did you get any response back from your letters?

    I'm going to write a letter now, I'll post it here hopefully someone on here will be able to make it look and sound better.

As you will see from your records that the default was obtained due to the excessive bank charges on my account, you will also see from your records that I have requested that the unfair charges to be paid back is greater than the defaulted amount.

    As the court have showed on a number of occasions that these bank charges are unfair I think that it will go a long way towards a gesture of good will that my default is removed.

    Which court? OFT test case is still under appeal. If the bank charges have yet to be reclaimed then the default is valid.

    But isn't it under appeal because the court said they were unfair?? And wont the default be invalid if the debt is disputed?

    I had a default removed, It was for £18! another for £100

    The £18 one, I stopped a mobile phone account when I moved and I didn't Know another bill was coming, I disputed the bill that got passed to a DC agency, they said Pay £20 of the £38 debt and we can call it quits, I said ok but the DC rep forgot to wright off the other £18!

    The other one was was a credit card, I moved quite a bit around this time of my life and had no idea either about this (admin not being my strong point then either!) but was able to argue it on the basis that I didn't receive a default notice. Took a little while to get it removed but I did!

    I got a website I found that gives u step by step but I cant link it, if you PM me ill give you the link if you like, else type in Default Removal with a full stop after it then 3 more letters...
