A&L PPI Reclaim Offer but NO PAPERWORK AS REQUESTED

Hello all,
I'm hoping for some helpful advise....
I recently wrote to A&L stating that I was reclaiming PPI on a loan of GBP 15,000 which was taken over 4 years as I believe I was missold following the FSA investigation, which subsequently found them guilty of misselling.
In my letter, I asked for the paperwork in respect of this loan as per the template included within this website. I then included information from 'stage 1' template requesting full refund of the money etc etc.
I have just received a letter from them offering me £3,609.01 in full and final settlement. This is made up of £2,804.93 as a refund for the period 22nd December 2003 to 25th April 2007 (when I settled the loan) plus the 8% interest totalling £804.08.
However, it doesn't include the requested paperwork so I can't check. They obviously have it as, when I originally wrote, I didn't have my loan account number. They have included it on their correspondence.
My other concern is, if you look on their loan calculator on their website it says that the cost of insurance on a loan of £15k over 4 years is £4,039.68.
I plan to write requesting the paperwork but has anyone had a similar issue so I could gain some valuable advice?

Hi hun
When you state you requested the paperwork, do you mean the actual agreement copy?
If you enclose a £1 postal order or cheque payment for this they should supply this to you within 12 days of request.
However its great news that they are giving you an offer:T :beer: and a great start, but the full breakdown of this I would also request for, as you have every right to these, ask them to post them out for as soon as possible, they obviously have them on hand to have worked this out for you, but at least you can see what is what here.
How long have they given you to accept it or not?
I would not go by the loan calculators either on the sites to be honest as everyone's can vary and the rates tend to change now and again, but I do understand what your saying here.
By asking for the breakdown of calculations they should also have the account number as well.

Yes, I meant the loan agreement.
I'm slightly dubious as to accept this offer on the basis that I might be short-changed. Obviously I am unable to check the figures without this paperwork. I did point out to A&L that I would contact the informatiuon commissioner if they didn't send it so I will write to them again specifically asking for a copy of my original agreement within the remaining timeframe to validate that their offer is a true and correct calculation of all monies paid by me in respect of insurance following the missale of PPI. Does this sound ok? I am unable to find a template letter on the website so could do with an honest opinion.
With regards to the offer, I have the usual 28 days to reply otherwise they will close my file etc etc.
The reason I mention the loan calculator is that surely £2,838 is a bit short. I'm fairly sure that they're trying it on so I take the money. Who wouldn't see a total of £3,600 (including interest) and immediately rip their hands off? Crafty thieves!!
I also have another question.....
Ever since around 1995, I must have had 4 loans with A&L, all of which have missold me insurance (i.e take the insurance or you don't get the loan). I'm sure that now they have found my records, these loans must also still be on record? Do you think it is worth me asking for agreement papers in respect of all loan accounts taken with A&L since 1995?? or is this going a bit too far?

I assume you enclosed the £1 payment they would normally expect to receive for the agreement request?
Yes I see what you mean here, but you do know if you feel done by, you can also take this to the FOS instead if you wanted to instead of accepting the offer, yet you may be waiting a long time before this is resolved due to the high volumes in these complaints.
But like you said without the calculations its not helpful with not having these to work on.
I would ask them what did they use to work these figures out, as they bound to have had something.
There is no harm in asking if they do still have any old paperwork from the older loans, although they may not have these any longer, but try anyway.
I could kick myself not keeping older paperwork, but then none of us were aware of this PPI mis selling then, and we do not think about keeping these, this is the annoying thing about it.
I would contact the ICO anyway and maybe they can get in touch with them on your behalf in regards to the paperwork.
To save me going back on the posts, did you request a SAR? (Subject Access request) SAR where they MUST supply EVERYTHING they have on you going back as far as 6 years, even though there is a cost of £10 cheque or postal order payment for this, but then they do have 40 days which takes it over the 28 days you have to get back to them - where I understand these days are going by already.
The calculations may have been provided within the SAR.

I've still got a two week timeframe to work with so I'll write a suitable response saying I will not be in a position to accept their offer unless they can substantiate the offer by providing my agreement.
I'll also request agreements in respect of all previous loan accounts and see how I get on.
They've only got 10 days before I speak to the ICO so I'll make this quite clear.
My final question is....
If I miss their deadline, is it going to predjudice my position?

Good for you and tell them you need this for as soon as possible. (before the deadline they have given you).
And give it a try for the other documents as well.
I think they should be fair with you here and any problem you do always have the FOS.

Hi There. Personally it is probably the one of all of them that has paid ++ to what I had expected. But saying that I can only talk about my personal experience on that. Probably the amount quoted is including interest. You are right to ask for the paperwork or at least how they have worked out the figures.

An update...
Following on from my posts above, I decided to ring A&L this morning and demanded to know where my agreement was. I mentioned to the young lady on the phone (who was very polite and helpful) that I requested this information over 30 days ago (I thought it was less but I actually wrote to A&L on 28th Jan) and was going to the IC and the FO if it wasn't with me within the next 14 days. I explained that I had received an offer but wasn't willing to accept it without the actual agreement so that I could calculate what I am owed in total and not just from their "offer".
She explained that she would request this information to be sent urgently but that it could take up to 10 days, which I am ok with as I was guaranteed that the deadline to accept their original offer would be extended. Either way, I'm sure the offer isn't a true reflection of what I am owed so will take it up with the Ombudsman if they start causing problems.
However, once I get the agreement and figures do you know how I can work out what I am owed correctly?
Also, I asked her to check her system to see if they had records of previous loans and guess what, they have record of a second loan with missold PPI! It turns out that this agreement expired in 2004 yet it is still on their systems. She is sending me all the details for this loan but cannot send the agreement as it is no longer on their files.
Once I get these I will post the details and would be grateful for some calculation advice.

Just to let you know I got the agreement and accepted the full amount owed of GBP 3,609!!
Result!
Even better tho, I've found out about an older loan that I'm now claiming for.
However, be careful. I phoned A&L customer services about the above noted £3.6k settlement and took the opportunity to ask about other loans. I was told I did have an older loan with PPI and details would follow by post, but because it was so old they wouldn't have a copy of the agreement. I said that's fine and put the phone down. I then thought I'd best follow this up in writing which I duly did. On the 6th March I had a letter from the original phone call confirming a loan of GBP 9,000 with "life" PPI cover.
This is where I get annoyed....
On the 16th March I had a reply to my follow up letter from their PPI division saying I had no other loans with PPI.
Hahaha! Wrong answer!
I sent a template one letter referring to the 6th March letter confirming the loan and requested settlement of all PPI.
I'm awaiting their response before sending the correspondence to the FSO and potentially the FSA. Even if they settle this do you think I should get the FSA involved?? I'm concerned that they're lying to customers again.
I'll keep you updated but thanks to everyone for their help with this.
