awarded dla but feel its wrong.do they do it on purpose

i was awarded middle care and low mobility..i thought i would have got high mobility and middle or high care..the reasons onthe letter stated i can walk quite well ,which i can,t.don.t need help turning at night etc..which is wrong..it even says i can manage the stairs after i told the visiting doc that i can,t...i was wondering should i appeal or could they turn round and make my award even smaller.... do you think when people apply for dla they give you less than they think you need knowing that a lot of people prob wont bother chasing for extra..i don,t know whether to be happy with what i have been awarded or appeal..

Yes you can appeal & yes they could make both your awards lower or take them away completely.
You need to take experienced welfare rights advice to see if they think it's worth putting your current awards at risk.
No, they certainly don't have a practice of giving people lower awards than the level they believe the applicant is entitled to in the hope that people won't bother appealing said award.The bigger the bargain, the better I feel.

Should be reasonably easy to mount a successful appeal as you will have evidence to disprove what they've said.
eg you have to sleep on the ground floor, person X turns you Y times during the night, you can demonstrate your walking difficulties......................I'm smiling because I have no idea what's going on ...:)0 -

To get high rate care you have to need help for a substantial part of the day and night,for high rate mobility you need to be unable or virtually unable to walk,if this applies to you then appeal,but get help from welfare rights or cab,and ask for an oral not written hearing if possible0 -
You can get DLA for mobility if you are in pain walking or if walking makes your pain worse as is the case with me.0

Thats perfectly true,but for higher rate you need to be as i said unable or virtually unable to walk,lower rate usually if walking short distances causes you severe pain or discomfort,or if you would be in danger in places or areas that arent familiar to you0 -

For people who are able to walk but need someone with them to provide guidance and supervision for most of the time when they are outdoors on unfamiliar routes. - Higher rate
For people who are unable to or virtually unable to walk.

Whilst i`m not about to get into an argument,there is the question of how far you can walk before you are in pain or discomfort,which can affect higher or lower mobility,with DLA nothing is simple0 - Lower rate

My best friend has fibromyalgia syndrome, and while she can walk, she cannot do anything without pain (I have it, too, and neither can I). She had to go to tribunal on her care award, but she has high rate mobility under the "severe discomfort" clause. So even if you can walk, you could still get HRM.Homosexual, Unitarian, young, British, female, disabled. Do you need more?0

this where its gets confusing as it's ok for some to get it but not others, think it's wrong but seems just luck of the draw ,who see your forms and passes themthe truth is out there ... on these pages !!0
