steps to go BR ? Seems too easy!

    Just checked with directory enquiries and this is the number they gave me. It seems to be constantly engaged at the moment, so sit down with a cuppa and have your finger on redial until you get through, but be patient you may be in fro a very long wait but they are excellent with housing advice. 08088004444

    Your inabilty(if thats the right word) to manage your finances,does not in any way whatsoever reflect your abilties as a parent.You will not have your children taken from you,so stop worrying on that count please.Dx

    If the worst comes to the worst,you may go into b&b. Start looking for rental properties NOW.

    Thanks Dalip - I think she might also be worried about her inability to keep a roof over her children's head when they have to leave the pub, if they have no home she is worried the children would be put in to care.

    Mrs Geoff - this is probably not an issue. The local authority are obliged to house you (in some way). But to be absolutely certain you could phone Shelter - details provided by Tigerfeet. The website is still down at the moment though.

    Can anyone relate experience of being homeless through repossession as a family and what local authority help was like?

    With us we were in Housing Association and buried our heads when our business was failing. We went away for a few days to my Grandfather's funeral. Got back at midnight on the Friday night to find that the locks had been changed on us. Had to go to our parents who put us up over the weekend.On Monday we went to the council with a letter from the parents to say they couldn't accomadate us (that was the hardest thing my FIL had to do, he hated it poor love.) We were told we had made ourselves intentionally homeless but they would put us in B&B for the moment and we would have to find a private rent. Thankfully my Dr. was brilliant and wrote to them regarding my mental health and they changed their minds and said they would rehouse us. We spent 9 months in B&B until we finally got a place.

    Hi,

    I had a read through your last thread, but could not see any idea of how much debt etc we are talking here - so maybe you could update us with this info ?

    But really, the main thing is, this is not the end of the world - and you probably do not need to go BR.

    In many cases, as soon as you make the decision to go BR, thats when you get the power not to - let me explain.

    Debt recovery and what have you in this country (outside of legal fines for crime etc) is based mainly on beating people with a bif stick of esculating threats to keep them paying up - it starts at the bottom with a nasty letter and goes all the way up to making you BR.

    But most of the time, its is only a threat. Companies do not, in general, want to make you BR - its very rarely worth it to them in terms of what they get back (in some cases just writing the debt off is better for them in terms of tax breaks) - so once you decide, hey, I dont care if I go BR - then suddenly no one has any big stick to hit you with !!!

    And what that means it they have to stop hitting and try to negotiate.

    Now the way I see it, without knowing your situation, is that you had the money to enter an IVA - ok you are struggleing now - but due to their nature they tend to be a bit costly (big debt cleared in 5 years) - so you should be able to negotiate a payment plan with those you owe.

    A payment plan (just to be clear) is you paying them a sum each month but as per IVA but you wont clear the debt after 5 years - it (in theory) goes on until the debt is cleared in full.

    Due to this, the sums you pay each month will be far lower than your IVA payments - in effect you pay what you can afford

    This sum, whilst small, is still usualy better for the creditor than the little (or nothing) they may recover via BR.

    Sorry - Ive rambled away here a bit and Im not sure how clear I have been, but hope you get the idea (maybe others can put it better than I can).

    The main thing is you should be able to stop worrying, and before you start looking at what you can repay, prioritise your outgoings and pay what needs to be done first - i.e your pub stock etc.

    Hope this helps - or is a starting point for further thought at least !

    According to JCS1 - he used to interview publicans at least once a week so thats an awful lot of families being made homeless - I'm sure their kids didn't go into care.

    Ok, phone your council tomorrow and get your forms filled in and sent back. make them aware of your situation and they will give you a number to phone as soon as you get your eviction notice. This will be the homeless action team, or something similar.

    As soon as you get your eviction notice you will be top priority, but may get put in a hostel or B&B to begin with, but they won't take your children away. Once you're in termporary and in the 'system' you'll be able to progress to permanent housing.

    It will help if you fill the forms in now, they will put you in the system so you're all ready to go when you need to, and it will help you to know that you've done something positive.

    36 pubs a week according to this article from September, so OP, you're not alone.

    Try not to worry mrs. jeff. I work in housing and a family with 4 kids who are actually going to be homeless (as opposed to fake eviction notices) will be top of the list in the emergency band. That means you will more than likely get housed within notice period and worst case like someone else said, you'll be placed in temporary bed and breakfast accomodation (not ideal but better than the streets as a short term measure). Your kids will not be taken away, it just wouldn't happen.
