DLA - I understated level of Care I need.

Options
I have been in receipt of the higher rate component of Mobility for about 5 months, since submitting the claim forms in October 2008.

I recall being over the moon to learn that I had been successful in receiving the Mobility rate at the time.

The letter I received from the DM said that I did not qualify for the Care component as I had actually written on the claim form that I received less help night and day with toilet needs and dressing that.

I think I understated my needs, probably out of pride and embarrassment.

I know it is too late to appeal, but thinking about it now, the extra money would be of great use now that I am benefit dependent.

DLA does say to contact them if your conditions change. Although mines have never really changed. Can I contact them to say that I had understated on the claim form and that I really could do with the Care component as I need it.

The toilet and dressing needs issues have been documented with my GP anyway and DLA would have had this info when they processed the claim originally, so would they need to contact my GP again?

  • Another quick question...

Do ATOS healthcare do the medicals for DLA?

I have had two ATOS medicals for DWP benefits in the past 5 months, both with the same doctor. the last time he apologised for seeing me as the first medical would have answered all his questions.

Hopefully, would not get another medical!!!!

Go into your local Citizens' Advice Bureau; they will have advisers who deal all the time with benefit claims, who will let you know if you can make a change of claim and will also fill in the forms with you.
  • hiya,

when your desicion can back is it for a certain amount of time? like has to be renewed every year?

i would pop along to CAB with all your papers and see what they say, if it needs renewing again this year it might just be worth waiting untill you renew it,

You need to take experienced welfare rights advice to ensure that your mobility award will not be under threat when applying for the care component of dla.

An experienced welfare rights advisor will be able to advice what your chances of a successful care claim are & also how to word the application form so that they know that you do not wish the mobility component to be looked at.

Yes it is Atos who do the medicals for DLA.
The bigger the bargain, the better I feel.

I should mention that there's only one of me, don't confuse me with others of the same name.
