HSBC Debt UPDATED

hi all

got a letter this morning from hsbc for oh current account..
he gets paid in cash now so no money goes through any account...

he owes them 3k (overdraft and charges)

they sent a letter saying he has to fill in all the forms provided within 7 days..

these forms are asking for...

employers name address telephone

earnings

outgoings

other debts- to who how much outstanding how much paying monthly...

do you own a car make reg number value

does anyone owe you anymoney...

do u live in.. own home with family......

other savings and bank accounts

also asking for partners employer address ect...

we have no problem setting up an arrangement with them but not happy to give them all this info...

have sent soa to companies before but never had to detail like this!!!!

if its his debt why do they want my employers name address telephone number!!!!

what do they need to know about my car for!!!!

or who i owe money to!!!

anyone had experience of this...

am quite upset as letter is very blunt...

please please please help anyone i wont get to sleep tonight with this on my mind....

    We had different accounts with HSBC my husband had credit card, loan, flexi loan, account with overdraft, i had credit card and bank account overdrawn. we also had a joint bank account.

    When we had huge debt problems we had advise from the CAB who sent them income/expenditure forms.
    Hsbc then passed the accounts onto Metropolitan collections service and we now pay £1.00 per month per account.

    I'm sure on this site you can find an income/expenditure form to download. Just fill it in and send them a letter offering what you can afford monthly and state that you can't afford anymore than the amount offered.

    Hope this helps but i wouldn't worry they have never done anything to us and we have huge debt with them altogether there over £15k

    come to think of it i once had a hsbc account that went to metropolitan...

    hsbc state in there letter that they will only accept monthly payments if i fill in the forms but im not prepared to do that...

    do you think it might be best to allow it to go to metro and arrange payment with them as i know they will be reasonable..
    i have £50 a month to throw at it now and in 3 months time will be able to throw nearly £500 a month till its clear so its not as if i dont want to pay just unwilling to give loadsa info they dont need....

    to add we already have defaults against us which should be settled by end of the yaear so another default wont do too much harm...

    I know it won't be the view of most but in my case letting it go to METROPOLITAN was the best method as they were more reasonable than HSBC.

    But i wouldn't worry about it.

    In a word, DON'T. They have NO entitlement to ANY information. You're doing your bit by giving them an income & expenditure sheet and whatever offer you are able to make to them on a monthly basis. Don't be bullied into giving them any other information.

    There's a link here to acceptable expenditure. Make sure you pay your priority debts before anything to creditors.

    the forms are so odd....

    i think i will let it go to metro as they will freeze intrest unlike hsbc adding intrest daily...

    wot do u guys think if wen it goes over, do u think metro would accept £50 per month... does this seem reasonable...

    this 50 would be min payment would pay extra when have it and in 3 months time be looking to throw 500+ per month til its clear....

    There is no quarantee metro will freeze the interest. It could also take months to get passed to them, during which time interest and charges are getting banged on. From their point of view the account is overdrawn and seems to be inactive. Asking questions is not unreasonable. Where they are unreasonable is in going over the top with their questions.

    I would work out how much you can afford to send them and put this into a income / expenditure statement of your own. Send this to them with your revised payment and just keep sending it every month whether they accept or not.

  • Hi, have you looked through your statements to tally nhow much of the overdrawn balance is due to their charges. You can go back six years, this may add up to a tidy sum and if deducted from your overdrawn balance would reduce their indebtedness. These charges are unenforceable visit https://www.bankchargeshell.co.uk and https://www.bankactiongroup.com for more info on how to get these charges back.

    This advice is spot on, it's all very well getting all militant with your lender (HSBC in this case) but presumably you want to resolve the problem so why wouldn't you co-operate to some extent ? You want them to make concessions and a) accept a lower payment, b) freeze interest, c) freeze/refund charges so why deliberatley put barriers in the way of sorting it out amicably ?

    Metropolitan are the recovery department for HSBC any way.

    Why give people information that they have NO right to? An income & expenditure account and an offer to pay is more than sufficient. Any request for further information is a gratuitous abuse of privacy and completely spurious.

    Ignore any posts (esp. from debt collectors) that say otherwise.
