Voluntary redundancy advice please

My husband's firm has been asking people for voluntary redundancies. They have already made 4 people redundant and are wanting more.

He really doesnt want to lose his job but he is considering the voluntary redundancy. The reason he is considering it is that they only have just under a months worth of work left and then nothing. The firm have been struggling for ages and there are worries that they may go into liquidation. So he is wondering if voluntary redundancy is the lesser of two evils as if he waits then in all likelyhood he will still be made redundant but then will only get statutory redundancy pay.

I have read on here that voluntary redundancy is seen as intentionally making yourself unemployed. But, I have also read on here that it is not seen that way (according to a TUC leaflet).

Which is right?

Like I said he doesnt want to lose his job but more money now is much better than lots less money in a few months time.

Can anyone point me to any DWP rules / guidelines or legislation please.

  • If there is a genuine redundancy programme and your husband volunteers for redundancy he should not be penalised for leaving his job voluntarily under the law affecting payment of Jobseekers Allowance.

    Voluntary redundancy schemes are adopted by some employers because it is the least painful way of shedding jobs for all parties involved. The overriding consideration is that jobs are ceasing to exist regardless of whether people are made redundant compulsorily or voluntarily and in such circumstances it is inappropriate to penalise someone as the result of a job loss for which they are not responsible.
