Nintendo DS warranty problems

I bought a new DS from Woolworths last November for a Christmas present, when it was opened Christmas day it didn't work. Alas no Woolworths to return it to, and my credit card company said because it only cost £89 I wasn't covered. So I returned it to Nintendo under warranty, they came back and said that the failure was caused by liquid contamination and wasn't covered under the warranty and that it would cost £59 to repair, I told them that it hadn't been out of the box and couldn't see where it could have become "liquid contamination, but they would not budge, so I now have £89 worth of Bright Green DS that doesn't work, any ideas ?

    I don't suppose you could request a report or explanation as to what they mean by "liquid contamination"?

    If Nintendo won't budge , get your local trading standards involved

    Get a report from Nintendo explaining 'liquid damage' and take that to your trading standards and explain your situation

    well woolworths are bust so you now need to go to the administrator and put in a claim against them as you are an unsecured creditor.

    Alternative option - buy a new DS the same colour from another retailer and when it arrives claim that it doesn't work and send back the duff one. Works best at places like argos but I'm not condoning it.

    really surprised that nintendo are being like this as ive had brilliant customer service off them. eldest son had a ds lite that died just after having it just over a year, i rang nintendo who sent me a reply paid label for repair and said they would inform me of the fault and cost. it arrived back with no charge completely fixed. They said it was an internal component fault so did not require charge.
    youngest son dropped his ds at christmas and cracked the bottom screen. it is with them at the mo being fixed, this cost me £53.85 i am more than happy with this as it is 1/2 the price of a new DS. (it is 18months old)

    Do you still have your reciepts etc? i suppose if nintendo wont budge then the only thing you can do is contact trading standards was the box damaged in any way to indicate water damage of any kind? I hope you manage to get this sorted

  • If Nintendo claim water damage as they did with my one bought from Argos, sue the seller. I did with Argos small claim court £30. Argos said do what you like we are not giving you a new one however once paper work dropped into their legal dept to defend claim I received a letter promising to settle out of court and that they had written to Court to advise them it had been settled. I havent received cheque yet but do have letter accepting they are not contesting case.
    i appreciate it wouldn't help in the case of Woolworth but Citizens Advice or someone with legal knowledge could tell you if you can sue Nintendo directly. As it is a small claim even if Nintendo bring Cherie Blair to defend them the most you lose is the fee you have paid.
    I think this is Nintendos standard response i knew my son hadnt got liquid on it as he was 5 and played under supervision if it had been older son 9 i might have assumed he had water damaged it and not have argued the toss.
