Moron delivery driver @ DHL

Ordered 2x5litre tins of water based acrylic paint on ebay the other day.
I was out briefly but the delivery driver from dhl who unless they were a body builder must have known how heavy the parcel was and throw it over our 6ft gate onto block paving behind the gate, which split the parcel and paint was running out luckily not on the paving must of it was contained in the parcel
Now I made a complaint to DHL, I know it isnt the sellers fault. The two tins were reasonable packaged inside and had extra packaging and brown tape over the lid. But the sheer force opened one of the tins and I lost about a 1/3rd of a tin of paint. Its waster based masonry paint and so luckily it can be cleaned up
Now I never had any issues with ebay have about 50 purchases and no bad feedback I donts sell on ebay.
I contacted the seller via ebay email and awaiting a reply, DHL said that its up to them to claim and then also told me the driver is at fault for not leaving a delivery card for redelivery he did leave a card to says "at side of garage behind the gate"
I also took photos of packaged and the gate

Don't quite know how the seller will claim for you gate. Sounds like the driver was a right tw@.
A reckless act (many will agree) and therefore criminal damage. If you get no where point this out to DHL and tell them you've reported the matter to the police.Hi, we’ve had to remove your signature. You may have a problem claiming, under DHL's own T&C's, Tins of paint may be classed as an excluded item:DHL will not carry, without specific agreement, any livestock, liquids, perishable goods, glass, gases, pyrotechnics, arms and ammunition or corrosive, toxic, flammable, explosive, oxidising or radioactive materials.
They could hide behind the bold disclaimers if they wanted to try and wriggle out of a claim. Someone else may be able to shed more light on that though, hopefully I am just being overcautious.We have removed your signature - please contact the forum team if you are not sure why - Forum Team0 -

The item would have been okay to deliver if it wasnt for the way it was delivered ie thrown over a 6ft garden gate. It should have been redelivered or left next door had he tried they were in one side and in most of time the other

If DHL do not allow the sending of liquids and the seller used DHL to send the paint... it's the seller's fault for choosing the wrong delivery firm0

you can claim against the seller
DHL could turn around and say this is exactly why they wont carry liquids
from my own experience.liquids leaking from parcels can end with you having claims for multiple damaged items
last we had damaged around 40 other packets and im sure all of these would be looking to claim from RM0 -

My understanding of DHL is that you have to declare all items before collection. Some are even inspected.
Does this mean the seller made a false description/declaration.
My point is - if the seller did not hide the true content from DHL and they agreed to carry, then it makes them liable.0 -
Thanks I have no idea about DHL as I said I bought it from ebay so if there is a get out clause which I was never told about when I made a complaint to DHL, then my only recourse is with the seller
Its still stupid and plain obvious to anyone but a moron that its heavy and may break being thrown over a 6ft gate0 -

This isn't gospel by anymeans, as in many cases people negotiate there own agreements, whether it by dimensions restrictions or goods restricitons.0
