Perhaps I misread the posts but :
As I read it the only car he hit was the one that was on the wrong side of the road, and that is also the person he is currently paying for damages.
He has a witness that this driver was a woman and not male as the other insurance company have stated.
OK re-read it again, and still missing something :
Who is he paying this money to ?
If he's paying the owner of the car that he hit that was on the wrong side of the road, he has a claim despite him not having insurance.
He could also contact the insurers and tell him that he has evidence(including witnesses) of one of their customers making a fruadulant claim. That can shake things up a bit.
If he's paying a different car owner, he should contact the court that imposed the fine and inform them of his change of circumstances and why he cannot continue to pay the fine (he should have done this 5 months ago when made redundant).0 -
I might be wrong but this is how I see what happened from the info provided
I must confess I read it differently but have now been back to the first post and become even more confused.
I took it that he slid under the car that was approaching on the wrong side of the road as the claim appears to have been made by a male but it was a female driving at the time.
What has confused me though is the nature of the court procedings. Bubblybaby - can you clarify this?
1) Police took him to court and fined him for no insurance etc - that is the criminal procedings.
2) Was an award made at the same hearing for the "victim" - the driver of the other vehicle? This is something the criminal courts do to give a measure of compensation to the victim.
3) Was the award made at a different time in a civil case in order to pursue an insurers outlay?
4) I suspect it is 3 and that the insurers are now looking to go back to court to enforce the payment terms.
5) Has there been any mention of the MIB - Motor Insurers Bureau?
If it is 3, then I would suspect this will make it hard to follow Gordons advice as the matter has it seems, already been heard in a court. You would need to get the entire judgment set aside and I'm not sure if this would even be possible, given that he has been making payments based on that judgment. The time to "set aside" must surely have passed.0 -
The post says he swerved to avoid an oncoming car on the wrong side, he then slide under another car who swore at him then drove off.
I'm guessing the first car did not stop and that the car he slide under is the one that has sued him or rather their insurers have as the post states the Insurers have been on at him as he has been missing payments.
I don't think we have all the facts on this matter but thats how I read it0 -

Prat i know!!!, a car came towards him on the wrong side of the road, he moved right over to the verge where he slid on ice and slid under a car. The female driver got out of the car shouted at him and drove off leaving him with a broken pelvis, hip and shoulder... A driver coming the other way stopped and helped him by calling the ambulance etc etc... She offered to be a witness as she had seen what had happened and that Adam had tried to avoid this women and also the fact that she left the scene.0

We will have to wait for more info from the poster, I'm just going by my interpretation of how they have worded it eg they refer to the car he swered to avoid and then rather than saying "Slid under THE car" they say "Slid under a car". This wouuld indicate to me they slid under a seperate car and would make sense ifhe has been found liable for damage
Hopefully the poster can shred some light onto the matter0
