car and disabled child

sorry if this has been asked before, we have returned our finance car to renault after £35 charges every week on the acc we just couldnt catch up and they advised they would take the car back with br. we have a very cheap second habd car value about £400 trade i think which we need for my sons transport due to his disability, my husband works from home so we dont need it for work purposes, are they likely to take it off us? im so worried we wouldnt be able to get him to appointments or get him out anywhere. thanks

    i will have to see if i can get something off the gp or paediatrician, i have his dla award letter but due to his age he currently gets medium care and no mobility when he turns 5 the end of may we can apply for mobility component, but will be going br before then, so hopefully the doctor will be supportive to it.

    Funnily enough my aunty had her OR interview this AM and she was told within 2 minutes of the start taht because she was in reciept of carers allowance for her brother they would not take the car or have any interest in it. And at top second hand price her car is around £1300-£1500.

    ooh thats great news for your aunty, i will just have to see what happens i think there may be a problem because im in recipt of the carers allowance but my husband owns the car (hes going br) but i cant drive so he drives the car for my sons needs, i have anxiety and depression and im too nervous to drive i also recieve dla ,just fingers crossed our OR isnt evil lol
  • You can apply for the higher rate of mobility once a child is three.

    You can then use that award to fund a motability car, with all the running costs, apart from the petrol, covered by motability. Any such vehicle is exempt from bankruptcy.

    It would seem you had been given the wrong advice.

    I have a motobility vehicle and i must warn you that follwoing BR the OR will write to motobility. Thereis a clause in every motobility lease that says they can cancel if you are declared BR. In our case motobility were happy to leave us with the car but only after they recieved a second letter from OR confirming they had no interest in vehicle. BUT be warned, others i know have had their vehicle taken back.... :(

    my health visitor said she didnt think it was right either, but dla said they dont think he would get higher rate and that cant apply for lower rate untill hes 5, he has autism so he can physically walk but he needs constant supervision when out, thats if you can actually convince him to walk and not roll around the floor kicking and screaming lol i just feel awfull making him sound so badly behaved on the forms i know im not doing myself any favours though. i think i will seek some advice on the forms would really help to have that money towards the car.
  • TMCD01 If the motability car is for the person who is declared BR that may be the case, but if you are the driver of the vehicle for one of your disabled children then it is not.

    JG1984 I would appeal your DLA decision if I were you as severe behavioural problems are just as serious as physical disabilities. One of the autism charities may be able to help you.
