4 day week question....

Hope someone can help....

Lots of redundancies have happened and now for the remaining staff of which fortunately my husband is one of them a 4 day week has been announced together with a 20% pay cut.

The day off is to be a monday, my question is -

as most bank holidays fall on a monday what are the statutory entitlements?

  • the statutory entitlements is 25 days. It doesnt include B/Hs.

You need to look at his old contract or his new one, if he has one.

Sorry but it isn't; the statutory minimum holiday entitlment is 4.8 weeks per year and includes bank holidays. So if you work a 5 day week you would get 24days total including the bank holidays.

From April the statutory minimum increases to 5.6 weeks per year including bank holidays so if you work a 5 day week 28 days including bank holidays.

OP whether your husband is paid for bank holidays will depend on whether his contract says he is; it is not obligatory, and also bear in mind his holiday entitlement will probably be pro rataed and scaled down as well as his wages.

  • Thank you for your replies....

so if his current holiday entitilement is 4 wks holiday per annum including bank holidays, from April 09 it will in effect have to be 4 wks holiday plus the bank holidays minus 20% of course ?....

    Do i understand this correctly...

    Thanks in advance

    No.

    You have got it wrong.

Its the difference in the interpretation of the words "including" & "not including".

Statutory entitlement do not include Bank Holiday at all. IE if someone says you have 25 days statutory holidays it is 25 days full-stop. If a bank holiday comes along & you take the day off it will go down to 24 days etc.

I suggest you read lineys comment again with the above in mind.

His current entitlement should be at least 4.8 weeks but this can include the bank holidys if his contract says so. 5*4.8 weeks equals 24 days - there are 8 bank holidays so he should get a minimum of 16 days floating to take plus be paid for the 8 bank holidays. If he works only 4 days you would reduce that by 20% as you said.
